85.,w 002884 <br />furthermore waive their right to protest the creation of any <br />sanitary sewer districts within said subdivision, <br />and to connect <br />the individual structures located in said subdivision to said <br />sanitary sewer mains within three construction seasons after <br />completion of the construction of said mains. <br />4. Storm,, Sewer. The Subdividers agree to grade the lots <br />of the subdivision in conjunction with the structures thereon so <br />that storm water drains to the public right-of-way in 'a manner <br />approved by the City's Director of Public Works. <br />5. Sidewalks. The City hereby waives the immediate con- <br />struction of any and all sidewalks adjacent to said subdivision <br />and within said subdivision. However, the Subdividers agree that <br />any and all sidewalks will be constructed by the lot owner within <br />six months after a directive from the Grand Island City Council. <br />6. Warranty. The undersigned owners, as Subdividers, <br />warrant that they are the owners in fee simple of the land <br />described and proposed to be known as a FAWNACRES FIFTH <br />SUBDIVISION, and that an abstract of title will be submitted for <br />examination, if necessary, upon request of the City of Grand <br />Island. <br />7. This agreement shall run with the land and shall be <br />binding upon and inure to the benefit of the parties hereto, <br />their successors, assigns, heirs, devisees, and legatees.
