85= 000311 <br />page 2 <br />5. Water Problem. It is understood by the parties <br />that the Lessee will be making extensive use of irrigation on the <br />leased premises and that a water problem, as defined by Nebraska <br />State Authorities, might develop because of such irrigation. It <br />is also understood by the parties that if such a water problem <br />develops and pumped ground water runs off into a county or state <br />ditch and /or unto other lands, then the landowner is responsible, <br />at his sole expense, for correcting such problem and preventing <br />such runoff pursuant to Nebraska law. The Lessor and the Lessee <br />shall mutually agree upon the specifications of correcting such <br />problem. Barring negligence by Lessee, Lessor shall also be <br />responsible for any damages to other parties caused by such <br />runoff and shall indemnify Lessee against any third party claims <br />caused by such runoff. <br />6. Irrigation Equipment. The Lessor represents and <br />warrants that there is located on the leased premises a well pump <br />and motor in good operating condition and sufficient to handle <br />the irrigation needs of the Lessee. Lessor shall, at his sole <br />expense, keep and maintain the well pump and motor in good <br />condition and repair during the term of this lease. In the event <br />any repairs ur adjustments to the well pump and motor are required <br />during the irrigation season and the Lessor cannot be immediately <br />contacted, or if contacted, does not immediately take the <br />necessary action to have the well pump and motor repaired and <br />placed in good operating condition, then the Lessee shall have <br />the right to have such repairs made and the Lessor agrees to pay <br />R <br />
