Mortgagee's option, declare the entire amount then owing <br />under this Mortgage to be immediately due and payable. Any <br />lease or granting of rights of possession of the real estate <br />to anyone without Mortgagee's prior written consent shall <br />also give Mortgagee the right to declare the entire amount <br />then owing under this Mortgage to be immediately due and <br />payable. <br />12. Acceleration for Yuck of Use. Mortgagor shall by <br />3uly, 1987, and continuing monthly thereafter until the <br />fifth anniversary of this Mortgage pay wages each month to <br />employees who perform their services on the real estate for <br />a daily average of 200 paid hours per day for each weekday <br />of that month which is not a general holiday for employees <br />of the City of Grand Island. if Mortgagor fails to keep its <br />employment at that average minimum level for two (2) consecutive <br />months, then Mortgagee may declare the entire unpaid balance <br />of the debt secured by this Mortgage to be immediately due <br />and payable. <br />13. Mortgagor agrees not to place or to allow to <br />remain if placed by others any liens or encumbrances upon <br />the real estate until Mortgagee has been ,paid in full under <br />this Mortgage. <br />14. Right to Perform. If Mortgagor should fail to pay <br />any taxes or installments of special assessments against the <br />property before it becomes delinquent, or shall fail to nay <br />any insurance premium when required to keep the insurance in <br />force, or shall fail to make repairs or perform maintenance <br />required under this Mortgage, then Mortgagee may do so for <br />the account of Mortgagor and recover from Mortgagor the <br />reasonable expense thereof with interest thereon at the rate <br />of fifteen percent (15 %) per annum until paid and this <br />Mortgage shall stand as security for that repayment and <br />Mortgagor's failure to immediately make the repayment shall <br />constitute a default under this Mortgage. <br />15. Remedies on Default. <br />A. If Mortgagor is in default for a sixty (60) <br />day period under any provision of this Mortgage, Mortgagee <br />may at Mortgagee's option <br />(i) declare the entire amount owing on this <br />Mortgage to be immediately due and payable, and <br />(ii) demand and receive immediate possession <br />of the real estate and apply all rents received therefrom to <br />the payments due hereunder. <br />Mortgagor shall be entitled to written notice of the making <br />of Mortgagee's choice under this subparagraph and after <br />giving said notice Mortgagee may bring an action to require <br />that :Mortgagee be put in possession of the real estate only, <br />or Mortgagee may bring an action to foreclose this "Mortgage <br />in the manner provided by law for the foreclosure of real <br />estate mortgages and be put in the possession of the real <br />estate during the pendency of the foreclosure proceedings. <br />B. The remedies set forth in subparagraph A of <br />this paragraph are not exclusive.
