I <br />ff,. 11",..._..1 <br /> <br />200802683 <br /> <br />RESOLUfION NO. 0'7 - "7 <br /> <br />WHEREAS, during the course oftbe development ofHoffinan Second Subdivision, <br />the developer, Gene Hoffinan, agreed to create a drainage ditch to facilitate the dIainage of said <br />subdivision; and, <br />WHEREAS, the Village of Doniphan through its Board of Trustees has requested <br />from the developer a formal easement or ownership of the necessary real estate to maintain and <br />conform the real estate for proper drainage use; and <br />WHEREAS, the developer has refused to transfer said real estate; and <br />WHEREAS, the real estate as hereinafter descnbed is necessary fur the proper <br />drainage of said subdivision and necessary fur the welfure of the general public of the Village. <br />NOW THEREFORE BE IT RESOLVED by the Chairman and Board of Trustees of <br />the Village ofDoniphan., Nebraska, that the Village's Attorney is hereby authorized on behalf of the <br />Village to commence acquisition of the followingdescn'bed real estate by purchase or condemnation <br />through the Village's power of eminent do~ to wit: <br /> <br />A tract of land located in the Southeast Quarter of the Southeast Quarter <br />(SE1I4SE1I4) of Section S.
