<br />5. Class "B" Allocated interests. Exhibit "G" of the Declaration titled "Schedule
<br />of Class "B" Allocated Interests" is hereby deleted in its entirety and Attachment "5" of
<br />the same title, attached hereto and incorporated herein by this reference, is hereby
<br />substituted therefore.
<br />6. Section 14(B). The Declaration on Page 12, Section 14(B) is hereby amended by
<br />deleting all references to "Unit 201" and substituting "Unit 201A" in lieu thereof.
<br />7. Definition of Class "B"- Limited Property. The Declaration at Page 4, Section
<br />1(H), is hereby amended by deleting the definition of Class "B "- Limited Property and
<br />inserting in lieu thereof the following definition:
<br />"The Class "B" limited common elements as shown in Exhibits "B" and "D ".
<br />In particular, Class "B "- Limited Property shall include all areas and spaces
<br />in the basement and on floors one and two which are not Class "B" Units,
<br />excluding Class "C" Property and Class "A "- Limited Property shown, which
<br />includes, but is not limited to, the elevators, stairways and hallways and
<br />entrance areas on floors one and two; including the designated areas in the
<br />basement, and all interior nonstructural walls, chases and partitions
<br />between Units of Class "B" Property, between "B "- Limited Property and
<br />Class "B" Property or between Class "B"- Limited Property and Class "C"
<br />Property. The Class "B "- Limited Property is reserved for the exclusive use
<br />of the Owners of Class "B" Property, who shall have an undivided interest
<br />therein as defined on the Schedule of Class "B" Allocated Interests,
<br />Exhibit "G ", attached hereto and incorporated herein by this reference;
<br />provided that certain Class "B "- Limited Property on the basement floor is
<br />reserved for the exclusive use of Unit 201A, Unit 201B and Unit 201C as
<br />shown on Exhibit "B ", Page 1 of 13 and Exhibit "D ", Page IA of 2; and
<br />further provided that certain Class "B "- Limited Property on the first floor
<br />is reserved for the exclusive use of Unit 102 and Unit 103 as shown on
<br />Exhibit "B ", Page 2 of 13 and Exhibit "D ", Page 1 of 2; further provided
<br />that certain Class "B "- Limited Property on the first floor is reserved for
<br />the exclusive use of Unit 103 and Unit 104 as shown on Exhibit "B", Page 2
<br />of 13 and Exhibit "D ", Page I of 2; and further provided that certain Class
<br />"B "- Limited Property on the second floor is reserved for the exclusive Use
<br />of Unit 201A, Unit 201B, Unit 201C and Unit 201D as shown on Exhibit "13 ",
<br />Page 3 of 13 and Exhibit "D ", Page 2 of 2.
<br />8. Class "B" Units. Devco Investment Corporation, a Nebraska corporation, as
<br />sole owner of all the Class "B" Units approved by vote this Second Amendment to
<br />Declaration of The Yancey, a Condominium.
<br />9. Amended Legal Description. The Declaration's legal description is amended to
<br />read as follows:
<br />Condominium Unit No. 001, 002, 101, 102, 103, 104, 201A, 201B, 201C,
<br />201D, 301, 302, 303, 304, 305, 401, 402, 403, 404, 405, 406, 407, 501, 502,
<br />503, 504, 505, 506, 507, 601, 602, 603, 604, 605, 606, 607, 701, 702, 703,
<br />704, 705, 706, 707, 801, 802, 803, 804, 805, 806, 901, 902, 903, 904, M,
<br />906, 1001, 1002, 1003, 1004, 1005, 1006, 1101, 1102, 1103, 1104, 1105, 1106,
<br />The Yancey, a Condominium, a condominium in accordance with the
<br />Declaration recorded on October 17, 1984, under Document No. 84- 005507
<br />of the County of Hall, State of Nebraska, records, as amended.
<br />The Property is now divided into sixty -seven (67) Units, fifty -seven (57) Class "A"
<br />Units and ten (10) Class "B" Units.
<br />10. Affirmed. The Declaration is hereby affirmed except as expressly modified by
<br />this Second Amendment to Declaration of The Yancey, a Condominium.
<br />11. Consent. This Second Amendment to Declaration of The Yancey, a Condo-
<br />minium, was consented to, voted upon and agreed to in writing by the Executive Board of
<br />The Yancey Condominium Association, Inc., a Nebraska nonprofit corporation and by
<br />Devco Investment Corporation, a Nebraska corporation as the entity entitled to cast all
<br />the votes of all the Class "B" Units in The Yancey, a Condominium as certified tj on the
<br />attached Certificate and was amended in accordance with the provisions of the
<br />Declaration and the Nebraska Uniform Condominium Act.
