<br />SECOND AMENDMENT TO DECLARATION
<br />TO
<br />THE YANCEY, A CONDOMINIUM
<br />As of this .'tom day of December, 1986, the Declaration of The Yancey, a Condo-
<br />minium, dated October 16, 1984 and recorded as Instrument No. 84-005507 in the
<br />Register of Deeds Office of Hall County, Nebraska, as amended by the Amendment to
<br />Declaration of The Yancey, a Condominium, dated March 1, 1986 and recorded as
<br />Instrument No. 86- 103108 in the Register of Deeds Office of Hall County, Nebraska
<br />(collectively "Declaration") for the following described real estate:
<br />Condominium Unit No. 001, 002, 101, 102, 103, 201, 301, 302, 303, 304, 305,
<br />401, 402, 403, 404, 405, 406, 407, 501, 502, 503, 504, 505, 506, 507, 601,
<br />602, 603, 604, 605, 606, 607, 701, 702, 703, 704, 705, 706, 707, 801, 802,
<br />803, 804, 805, 806, 901, 902, 903, 904, 905, 906, 1001, 1002, 1003, 1004,
<br />1005, 1006, 1101, 1102, 1103, 1104, 1105, 1106, The Yancey, a
<br />Condominium, a condominium in accordance with the Declaration recorded
<br />on October 17, 1984, under Document No. 84- 005507 of the County of Hall,
<br />State of Nebraska, records,
<br />is hereby amended by this Second Amendment to Declaration of The Yancey, a
<br />Condominium. Any reference herein to a numbered condominium unit ( "Unit ") shall
<br />be legally described as follows:
<br />Condominium Unit No. _, The Yancey, a Condominium, a condominium in
<br />accordance with the Declaration recorded on October 17, 1984, under
<br />Document No. 84- 005507 of the County of Hall, State of Nebraska, records,
<br />as amended.
<br />The Declaration is hereby amended as follows:
<br />1. Exhibit B, Page 1 of 13. Exhibit "B ", Page 1 of 13 to the Declaration is hereby
<br />amended by deleting Exhibit "B", Page i of 13 in its entirety and inserting in substitution
<br />therefor as Exhibit "B ", Page 1 of 13 and inserting as a new Page IA of Exhibit "D" that
<br />plan set out in Attachment "1 ", attached hereto and incorporated herein by this refer-
<br />ence. Attachment "1" which is now part of the Declaration allocates certain Class
<br />"B"- Limited Property space measuring 15.0 feet by 34.83 feet in the basement to the
<br />exclusive use of Unit 201A.
<br />2. Exhibit "B ", Page 2 of 13 and Exhibit "D ", Page 1 of 2. Exhibit "B ", Page 2 of
<br />13 and Exhibit "D ", Page 1 of 2 to the Declaration is hereby amended by deleting
<br />Exhibit "B", Page 2 of 13 and Exhibit "D ", Page I of 2 in their entirety and inserting in
<br />substitution therefor as Exhibit "B ", Page 2 of 13 and Exhibit "D", Page 1 of 2 that plan
<br />set out in Attachment "2 ", attached hereto and incorporated herein by this reference.
<br />Attachment "2" which is now part of the Declaration subdivides Unit 101 into Unit 101
<br />and Unit 102; changes the condominium unit number of Unit 102 to Unit 103; changes the
<br />condominium unit number of Unit 103 to Unit 104; increases the size of the condominium
<br />units now known as Unit 102 and Unit 103 by reducing the size of certain Class
<br />"B"- Limited Property on the first floor and allocating such Class "B "- Limited Property
<br />space to the exclusive use of Unit 102 and Unit 103; and allocating other Class
<br />"B"- Limited Property space on the first floor to the exclusive use of Unit 103 and
<br />Unit 104.
<br />3. Exhibit "B" P, age 3 of 13 and Exhibit "D ", Page 2 of 2. Exhibit "B", Page 3 of
<br />13 and Exhibit "D ", Page 2 of 2 to the Declaration are hereby amended by deleting
<br />Exhibit "B", Page 3 of 13 and Exhibit "D ", Page 2 of 2 in their entirety and inserting in
<br />substitution therefor as Exhibit "B ", Page 3 of 13 and Exhibit "D ", Page 2 of 2 that plan
<br />set out in Attachment "3 ", attached hereto and incorporated herein by this reference.
<br />Attachment "3" which is now part of the Declaration, alters the area of the Class
<br />"B"- Limited Property on the second floor; reduces the size of the Class "B" Property;
<br />subdividing the remaining space of Unit 201 into Unit 201A, Unit 2018, Unit 201C and
<br />Unit 2011); and allocating a portion of the Class "B "- Limited Property space to the
<br />exclusive use of Unit 201A, Unit 20113, Unit 201C and Unit 201D as snown on
<br />Attachment "3 ".
<br />4. Allocated Interest on General Issues. Exhibit "E" of the Declaration titled
<br />"Schedule of Allocated Interests" is hereby deleted in its entirety and Attachment "4" of
<br />the same title, attached hereto and incorporated herein by this reference, is herebv
<br />substituted therefore.
