<br />NEBRASKA CROSS - COUNTIES GIRL. SCOUT COUNCIL, INC., now known as GOLDENROD
<br />GIRL SCOUT COUNCIL. INC., herein called the Grantor, in consideration of
<br />Two Hundred Eighty Dollars ($280.00) receipt of which is hereby
<br />acknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the Grantee, a
<br />permanent and perpetual easement and right -of -way to survey, construct,
<br />reconstruct, relocate, inspect, repair, replace, extend, add to, maintain,
<br />operate, and remove thereon, a water transmission pipe line, equipment, and
<br />other appurtenances connected therewith, along, across, underneath, and
<br />through a fifty (50.0) foot wide tract of land located in the Southwest
<br />Quarter (SW -1/4) of Section Two (2), Township Ten (10) North, Range Nine (9)
<br />West; and the Northwest Quarter (NW -114) of Section Eleven (11), Township Ten
<br />(10) North, Range Nine (9) West; all of the 6th P.M., Hall County, Nebraska;
<br />mole particularly described as follows:
<br />A fifty (50.0) foot wide tract of land, lying twenty seven
<br />(27.0) feet North and twenty three (23.0) feet South of the
<br />common line between said Section Two (2) and said Section
<br />Eleven (11); from the Easterly lines of Lot Four (4) of
<br />said Section Eleven (11) and Lot Five (5) of said Section
<br />Two (2), to the Westerly lines of Lot Two (7) of said
<br />Section Eleven (11) and Lot Six (6) of said Section Two (2).
<br />The above said tract containing 0.56 acres, more or less,
<br />as shown on the plat dated 6/13186, marked Exhibit
<br />attached hereto, and incorporated herein by reference,
<br />together with the following rights:
<br />1. Grantee shall have the right of ingress and egress across Grantor's
<br />property for any purpose necessary in connection with the survey,
<br />construction, reconstruction, relocation, inspection, repair, replacement,
<br />extension. addition to, maintenance, operation, and removal of said water
<br />transmission pipe .line. Such ingress and egress shall be exercised in a
<br />reasonable manner.
<br />2 The Grantee covenants and agrees with the Grantor that it will
<br />defend, protect, save harmless, and indemnify the Grantor from and against all
<br />liability, loss, damage, claims, and expense suffered by or imposed on the
<br />Grantor, by reason of the survey, construction, reconstruction, relocation,
<br />inspecting, repairing, replacing, extending, adding to, maintaining,
<br />operating, acrd removing the water transmission line by the Grantee.
<br />:3. Grantee shall have the right to trim, clear, or remove all trees and
<br />brush on said right- of-way as may be necessary to efficiently survey,
<br />construct, reconstruc=t, relocate, inspect, repair, replace, extend, add to,
<br />maintain, operate, and remove said water transmission pipe line. All refuso
