86- 104388 <br />days thereafter, Tenant shall furnish a title report to-First <br />�`- Party showing title defects, if any, to the premises. Landlord <br />shall then have a reasonable opportunity to correct any title <br />defects disclosed by a title report, or title insurance commit- <br />ment. Closing of the sale under the option shall be completed <br />within ninety (90) days of the exercise of the option, at which <br />time Landlord shall exchange a Warranty Deed to the premises <br />and Bill of Sale for any furnishings and fixtures being pur- <br />chased by Second Party in exchange for cash or certified funds <br />as provided herein. Failure of Tenant to close at that time <br />shall act as an expiration of this option and termination of <br />all further rights hereunder, and all prior sums paid under <br />the Lease or the option would be forfeited to Landlord. <br />4. The Tenant agrees that throughout the term of this <br />Lease Agreement, that the Tenant shall assume and be responsible <br />for each of the following: <br />a. Tenant will pay each month's rental on or before <br />the 5th dal of each month. <br />b. Tenant will not sublet or allow any other Tenant <br />to come in with or under him, without the written consent of <br />Landlord; that Tenant will repair all injuries or damages done <br />to the premises during her occupancy, or pay for the same. <br />C. That Tenant will comply with all City Ordinances <br />and will take good care of the buildings and premises and its <br />contents and keep them free from filth, danger or fire or any <br />nuisance. <br />d. That in default of payment of any monthly rental <br />for a period of thirty (30) days after the same is due, Tenant, <br />after written notice of non - payment and intention of Landlord <br />to terminate the Lease, will, at the request of Landlord, quit <br />and surrender to the Landlord the peaceable possession of the <br />premises in as good condition as the same was received, usual <br />wear excepted. <br />5. The Landlord shall be responsible for maintaining <br />insurance on the premises in such amount and under such coverage <br />as the Landlord shall determine to be appropriate. All property <br />of every kind and nature belonging to the Tenant, which may be <br />in or about the property, shall be at the risk and responsibility <br />of the Tenant, and the Landlord shall not be liable for damage <br />thereto or theft, misappropriation, or loss thereof, the active <br />and actionable negligence of the Landlord excepted. In addition_, <br />the Landlord shall be responsible for payment of all general real <br />estate taxes for the premises during the term of this Lease and <br />any special assessments levied against the premises for the same <br />oeriod. <br />5. Tenant shall be .responsible and obligated for any and <br />all utility charges incurred in connection with the lease premi- <br />ses, including, but not limited to, water, sewer use fees, <br />-2- <br />U <br />
