86. <br />the reasonable security, building code and fire exit needs and <br />requirements of Lots 1, 2 and 3, needed <br />Section 12.13. A non-exclusive easement so long as <br />over such portion of Lot I and a non-exclusve irrevocable license <br />over the abutting alley for the benefit Of and appurtenant to the <br />North half of Block 79, Original Town of Grand Island, Nebraska <br />(as reasonably required) for the purpose of allowing the Owner of <br />Lots 1, 2 or 3 to construct at a later date a skywalk and related <br />and necessary <br />stairwells, elevato rs, columns, Utility Conduits <br />Improvements thereon in accordance with construction documents <br />approved by the City of Grand island and to operate and maintain <br />Improvements for the purpose of providing <br />a skywalk and related 'Imp <br />Skywalk access to the Parking Gar age; provided that such con- <br />struction, operation and/or maintenance shall be undertaken, to <br />the extent reasonably practicable, in the least disruptive manner <br />with respect to the then uses of Lot 1 and the abutting alley and <br />the Improvements thereon and such Improvements shall promptly be <br />restored to their original condition at no co st to the Owners and <br />Tenants of Lot 1 and the abutting alley; and provided that the <br />skywalk bridge over Lo t 1 shall be higher than twelve (12) feet <br />and the skywalk bridge over the abutting alley shall be higher <br />than fourteen (14) feet. <br />Section 12.14. 2.14. if, after the completio n of the development <br />_'- <br />the Parties agree that a particular <br />of improvements on a Lot, <br />easement granted or res erved hereunder is not necessary or should <br />be terminated far some other reason or should be modified or <br />-33- <br />
