I <br />86- 101908 <br />This Assignment is given as security for the indebtedness <br />mentioned hereinabove and as security for such other sums as may <br />be advanced in accordance with the terms of the aforementioned <br />Mortgage Note, as extended and modified, and this Assignment. In <br />the event such indebtedness, future advances, interest and such <br />other sums as may be advanced in accordance with the terms of the <br />aforementioned Mortgage Note, as extended, and this Assignment <br />are well and truly paid in accordance with the terms therein <br />contained, then this Assignment shall be void, otherwise to <br />remain in full force and effect. <br />At any time after default of Assignors has been declared by <br />Assignee, Assignee may cause notice to be served upon the named <br />Lessee and Guarantors in the aforedescribed Lease Agreement, <br />directing that all future payments to be made by such Lessee and <br />Guarantors be made directly to Assignee, and such payments <br />thereafter received by Assignee shall be applied against any then <br />existing indebtedness owed by the Assignors to Assignee. <br />In the event of default by Assignors, Assignors further <br />constitute Assignee their true and lawful attorney for Assignors <br />and in their names, but for the sole use and benefit of the <br />Assignee and its assigns to collect, demand, sue for, in its own <br />name and right, receive, compound, settle and compromise any sums <br />owing by Guarantors or Lessee under such Lease Agreement to <br />Assignors and apply the same to indebtedness owing to Assignee <br />from Assignors. <br />It is the intention and agreement of the Assignors that this <br />Assignment shall also secure any future advances made to Assignors <br />by Assignee and any and all indebtedness in addition to the <br />amount stated above which said Assignors, or any of them, may owe <br />to said Assignee, however evidenced, whether by note, book, <br />account or otherwise. The undersigned also agrees that this <br />Assignment shall secure all costs, charges and expenses reason- <br />ably incurred or paid by Assignee, including reasonable attorney <br />fees, because of the failure of the undersigned to comply with <br />the terms of the Mortgage Note aforementioned, as extended and <br />modified, or this Assignment. <br />The failure of the Assignee to assert any of its rights <br />hereunder at any time shall not be construed as a waiver of its <br />right to assert the same at any later time, and to insist upon <br />and enforce strict compliance with all the terms and provisions <br />of said Mortgage Note, as extended and modified, and of this <br />Assignment. !� <br />Dated this lu'/ day of ; I 1986. <br />! f <br />len,fietb B .
