86-- 101049 <br />the then owner of Lot 1, shall provide i.mprovements.at such time <br />and standards, approved by the Hall County Director of Public <br />works, for said north 126 feet of Juergen Road, that such road <br />is officially dedicated and under improvement north of and imme- <br />diately adjacent to this subdivision or whenever an accessory <br />building is placed on the north 126 feet of Lot 1, whichever <br />occurs first. <br />Warranty. The undersigned owners, as Subdividers, warrants <br />that it is the owner in fee simple of the land described and <br />proposed to be known as Fireside Interstate Plaza Second Sub- <br />division, and that an Abstract of Title will be submitted for <br />examination, if necessary, upon request of the County of Hall. <br />This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their <br />successors, assigns, heirs, devisees, and legatees. Where the <br />term "Subdivider" is used in this agreement, the subsequent owners <br />of any lots in the Subdivision shall be responsible to perform <br />any of the conditions of this agreement if the Subdivider has not <br />performed such conditions. <br />Dated: <br />Elvin R.
