<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That JOHN R. BROWNELL, successor Trustee, upon a Deed of
<br />Trust made and entered into on or about the 10 day of April,
<br />1981, by and between Terry L. Giboney and Pattie G. Giboney,
<br />husband and wife, Trustors, and James Simdorn, Trustee, and
<br />Beneficiary, State Bank of Dannebrog, recorded as Document No.
<br />81- 001779 in the Office of the Register of Deeds of Hall County,
<br />Nebraska, on April 10, 1981, which Deed of Trust was assigned to
<br />the Nebraska Mortgage Finance Fund, on April 10, 1981, and
<br />recorded in the Office of the Register of Deeds of Hall County,
<br />Nebraska, on May 19, 1981, as Document No. 81- 002575, and re-
<br />recorded on February 5, 1982, as Document No. 82- 000468, and
<br />subsequently Lawyers Title Insurance Corporation was named
<br />Trustee by a Substitution of Trustee recorded in the Office of
<br />the Register of Deeds of Hall County, Nebraska, on the 19 day of
<br />August, 198x, as Document No. 81- 004257, and subsequently John R.
<br />Brownell was named successor Trustee by a Substitution of Trustee
<br />recorded in the Office of the Register of Deeds of Hall County,
<br />Nebraska, on October 31, 1985, as Document No. 85- 005428, L d
<br />John R. Brownell, herein called the GRANTOR, in consideration u'_
<br />Thirty Five Thousand Two Hundred Seven Dollars and Seventy
<br />Three Cents ($35,207,73) and other valuable consideration,
<br />received from GRANTEE, does hereby grant, bargain, sell, convey,
<br />and confirm unto Nebraska Investment Finance Authority, herein
<br />called the GRANTEE, the following described real estate in Hall
<br />County, Nebraska:
<br />West Seventy Severe (77) Feet of Lot Two Hundred Twenty
<br />Eight (228), in West Lawn, an Addition to the City
<br />Grand Island, Hall County, Nebraska,
<br />to have and to hold the above - described premises together with
<br />all tenements, hereditaments, and appurtenances thereto belonging
<br />unto the GRANTEE and to GRANTEE'S successors and assigns forever..
<br />GRANTOR does hereby covenant with the GRANTEE and with the
<br />GRANTEE'S successors and assigns:
<br />1_ That Terry L. Giboney and Pattie G. Giboney, husband and
<br />wife, Trustors, failed to pay the Beneficiary payments which were
<br />contractually due, and the GRANTOR, at the request of the Bene-
<br />ficiary, elected to declare the entire unpaid principal balance,
<br />together with interest thereon, at once immediately due and pay-
<br />able;
<br />2. That a Notice of Default was filed by GRANTOR on
<br />November 5, 1985, as Document No. 85- 005540 in the Office of the
<br />Register of Deeds of Hall County, Nebraska. A copy of the Notice
<br />of Default was served upon Terry L. Ciboney, 2109 West 15 Street,
<br />Grand Island, Nebraska 68801 and Pattie G. Giboney, 2109 West 15
<br />Street, Grand Island, Nebraska 68801 and at 2124 West Waugh,
<br />Grand Island, Nebraska 68801 by certified mail, return receipt
<br />requested, postage prepaid, on November 7, 1985:
<br />3. That Trustors, Terry L. Giboney and Pattie G. Giboney,
<br />failed to cure the default referenced in the Notice of Default
<br />within thirty days after the service of the Notice of Default;
<br />4. That a copy of the Notice of Trustee's Sale was served
<br />upon Terry L. Giboney, 2109 West 15 Street, Grand Island,
<br />Nebraska 68801 and Pattie G. Giboney, 2109 West 15 Street, Grand
<br />Island, Nebraska 68801 and at 2124 West Waugh, Grand Island,
<br />Nebraska 68801 by certified mail, return receipt requested,
<br />postage prepaid, on December 18, 1985;
<br />5. GRANTOR published Notice of Trustee's Sale, to be held
<br />on January 27, 1986, at 10:00 o'clock a.m., at the lower lobby of
<br />the Hall County Courthouse in Grand Island, Hall ('ounty,
