L � <br />J <br />-2- <br />87- 106938 <br />3. <br />Grantor shall perpetually make the easement granted herein <br />available to the Grantee for its use, but shall maintain <br />the easement, which is Twenty -Five Feet (251) in width, <br />operable and usable at all times as needed for its use. <br />To the extent that the level of use by the Grantee requires <br />maintenance over and above that required for Grantor's <br />purposes, the expense of such additional maintenance shall <br />be borne by the Grantee. In the event the Grantor determines <br />that hard surfacing or other like betterments to the ease- <br />ment area are necessary and for the benefit of both Grantor <br />and Grantee, it may install such betterment at its own <br />expense unless otherwise agreed by the parties. Prior <br />to installation of such betterment, the Grantor shall give <br />Grantee thirty (30) days written notice of its intent to <br />do so. <br />4. <br />Grantor shall have the right to erect and maintain one <br />or more gates or other security facilities along or <br />upon the easement, but in such event, it shall furnish <br />to Grantee, its agents, employees and invitees, such keys, <br />combinations, or other means of access as are necessary <br />to afford Grantee, its agents, employees and invitees, <br />convenient ingress and egress. <br />5. <br />Grantee shall provide liability insurance coverage protecting <br />the Grantor against all claims arising out of Grantee's <br />use of the easement granted herein, for damage to property <br />or injury to person or persons in a single limit amount <br />of at least $1,000,000.00. The liability policy shall contain <br />a provision that it may not be canceled without twenty (20) <br />days written notice to the Grantor, and copies of such <br />policies or certificates of insurance shall be made avail- <br />able to the Grantor during all times that the easement is <br />in force and effect. <br />6. <br />In the event that Grantee fails to provide the insurance <br />coverage as above provided, then Grantor may procure such <br />insurance coverage and the cost of the same shall be a <br />charge or lien against the real property described in <br />Exhibit "A ", until such time as Grantee reimburses Grantor <br />for the expense of such insurance coverage. <br />7. <br />In the event Grantee abandons the easement, the easement <br />granted herein shall terminate. The buyer's failure to <br />utilize the easement at least one (1) time in any calendar <br />year shall be deemed to be an abandonment. <br />foregoing <br />IN WITNESS WHEREOF the parties have executed the above and <br />Easement <br />Grant on the 23 day of %7Orevtrb,?K 1987. <br />L � <br />J <br />
