( <br />In <br />1 <br />87- 106938 <br />GRANT OF ROADWAY EASEMENT <br />For and in consideration of the sum of Ten Dollars ($10.00), <br />receipt of which is hereby acknowledged, together with other <br />good and valuable consideration, being the covenants contained <br />in a Contract of Sale between the parties dated July 27, 1987, <br />the undersigned WERNER CONSTRUCTION CO., a Nebraska Corporation, <br />Grantor, hereby gives, grants and conveys to the PLATTE RIVER <br />WHOOPING CRANE MAINTENANCE TRUST, INC., a Nebraska Nonprofit <br />Corporation, Grantee, a permanent and perpetual easement Twenty - <br />Five Feet (251) in width for ingress and egress to the real <br />property sold by Grantor to Grantee and described on Exhibit "A" <br />hereto attached and made a part hereof, the center of said road- <br />way easement to begin at Point B on Exhibit "B" which is approximately <br />Twenty -One Feet (21') South of the Northwest Corner of the North- <br />east Quarter of the Southeast Quarter of Section Six (6), Town- <br />ship Nine (9) North, Range Ten (10), West of the 6th P.M., Hall <br />County, Nebraska, thence running West 3,785 feet, thence running <br />in a West - Southwesterly direction a distance of Seventy -Five <br />Feet (751), thence running West and intersecting the county road <br />(being known as the Alda Road) at a point which is approximately <br />One Hundred Forty -Five Feet (145') South of the Northwest Corner <br />of the Northwest Quarter of the Southwest Quarter of Section Six <br />(6), Township Nine (9) North, Range Ten (10), West of the 6th <br />P.M., Hall County, Nebraska, said easement extending 12.5 feet <br />in each direction from said center line. The easement granted <br />herein is shown on Exhibit "B" as commencing at Point B and <br />terminating at Point A and shall generally remain in such <br />location, subject however to the right of Grantor to, upon <br />Thirty (30) days written notice to Grantee, move or change the <br />location of such easement or any part thereof, it being understood <br />that Grantee shall have equally convenient access, being Twenty - <br />Five Feet (25') in width, to its property described in Exhibit <br />"A" at all times and it being further agreed that the easement, <br />if changed in location, will remain in close proximity to its <br />existing location. <br />The easement granted herein shall be subject to the following <br />terms and conditions: <br />1. It shall be used by the Grantee for the purposes for which <br />Grantee was incorporated, that being migratory bird habitat <br />and related uses and activities, including cattle management <br />and transportation. <br />2. No more than One Hundred Seventy -Five (175) two -way trips <br />may be made by vehicles of the Grantee or its agents, <br />employees or invitees, in any five (5) consecutive day <br />period, unless specific permission for additional vehicle <br />use is obtained in writing from Grantor, which permission <br />shall not be unreasonably withheld. <br />L <br />J <br />
