WHEREAS, certain differences and disagreements have arisen <br />during the course of the marriage; and <br />WHEREAS, a Petition asking that the marriage be dissolved <br />is currently pending; and <br />WHEREAS, the parties are desirous of settling matters of <br />the division of real estate and personal property between themselves. <br />The following constitutes a full and complete agreement as between <br />the parties. <br />1. The residence of the parties, the legal description of <br />which is attached hereto and marked "Exhibit A ", is awarded to the <br />Respondent. <br />2. Petitioner is awarded $5,000:00 a: a full and complete <br />property settlement. <br />3. The Petitioner acknowledges receipt of the above mentioned <br />$5,000.00, which are the proceeds of a real estate mortgage negotiated <br />for that purpose by the Petitioner and the Respondent upon the real <br />estate legally described upon "Exhibit A ". <br />4. The Petitioner was required to join in the signing of the <br />aforementioned mortgage upon said real estate, and it is stipulated <br />and agreed upon by the parties, that the premises shall not be further <br />mortgaged or transferred until this mortgage has been fully and <br />completely paid by the Respondent, who shall hold the Petitioner <br />harmless from any obligation thereon. <br />5. Each of the parties shall keep the personal property now in <br />their possession. <br />
