L <br />QUITCLAIM DEED 87. 106086 <br />1. The City of Grand Island, Nebraska, by action of its <br />City Council on August 31, 1987, enacted Ordinance No. 7403 which <br />directed the conveyance of the real estate described below and <br />the manner and terms thereof. <br />2. ordinance No. 7403 was published in the Grand Island <br />Daily Independent, a legal newspaper published in and of general <br />circulation in such City on September 7, 1987, and immediately <br />thereafter notice of such sale and the terms thereof were pub- <br />lished in the Grand Island Daily Independent for three consecut- <br />ive weeks, on September 8, September 15, and September 22, 1987, <br />all as required by Section 16 -202, R.R.S. 1943. <br />3. No remonstrance against such sale was filed with the <br />City Council of the City of Grand Island, Nebraska, within thirty <br />days of the passage and publication of such Ordinance No. 7403. <br />4. Section 5 of Ordinance No. 7403 provides that if no <br />remonstrance be filed against such conveyance, the mayor and city <br />clerk- finance director shall make, execute, and deliver to the <br />Grantees a quitclaim deed for said real estate, and the execution <br />of such quitclaim deed is hereby authorized without further <br />action on behalf of the City Council. <br />NOW, THEREFORE, the City of Grand Island, Nebraska, a muni- <br />cipal corporation in Hall County, Nebraska, as Grantor, in con- <br />sideration of One Dollar ($1.00) does hereby quitclaim, grant, <br />bargain, sell, convey, and confirm unto <br />CHARLES A. DOUTHIT and DONNA M. DOUTHIT, <br />husband and wife, as joint tenants with right of survivorship, <br />herein called the Grantees, the following described real property <br />in Hall County, Nebraska: <br />A part of the Northwest Quarter of the Southwest <br />Quarter (NW 1/4 SW 1/4) of Section 21, Township 11 <br />North, Range 9 West of the 6th P.M., more particularly <br />described as follows: <br />Beginning at the Southeast corner of Lot 2, Brach's <br />Third Subdivision, Grand Island, Nebraska, said point <br />begin on the West right -of -way line of Harrison Street; <br />thence West on the South line of said Lot 2 a distance <br />of 199.0 feet; thence South parallel to the West <br />right -of -way line of Harrison Street a distance of 25.0 <br />feet; thence East parallel to the South line of said <br />Lot 2 a distance of 199.0 feet; thence North on the <br />West right -of -way line of Harrison Street a distance of <br />25.0 feet to the point of beginning, containing 0.114 <br />acres, more or less; <br />provided, however, that the Grantor hereby expressly reserves <br />unto itself and assigns a permanent and perpetual easement and <br />right -of -way to construct, operate, maintain, extend, repair, <br />replace, and remove public utilities, including but not limited <br />U <br />J <br />
