1 ADDENDUM 'A' <br />% 10558 <br />ADDENDUM 'A' TO RIGRT-OF -WAY GRANT <br />between Nall Count . and <br />AT6T Communications of the Midwest, Inc., doing business at One North <br />Wacker Drive, Chicago, Illinois 60606, dated 9- -28 -87 <br />covering land located in Section 2 Township 1; North, Range <br />9 West, Hall County, Nebraska. <br />Grantee agrees to bury cable a minimum of 5 (five) feet below surface <br />and to encase in steel pipe for a minimum distance of 75 feet either <br />side of the extended runway center line. <br />Grantor reserves the right to cross said easement with roads, drive- <br />ways and other utilities, including runway approach lighting and <br />extension of runway safety area. <br />Grantee agrees that the rights granted shall be subordinate to the <br />Grantor for the operation, maintenance and development to the airport. <br />In the event of imminent development operations in the immediate <br />vacinity of said cable, Grantor will provide Grantee with at least <br />6 months prior written notice. Grantee will, at its expense, relocate <br />cable on the above described real estate to facilitate development. <br />Grantee agrees not to construct above - ground lines or structures upon <br />said easement strip, except for markers at fence lines and property <br />lines as shown on the attached Exhibit W. <br />Grantor shall not be liable to Crantee for accidental damage to <br />Grantee's cable or other facilities resulting from the operation of <br />farm machinery within the easement area in the course of normal <br />farming operations. <br />Grantor also shall not be liable to Grantee for accidental damage to <br />Grantee's cable or other facilities occurring in the course of excavating <br />or digging in or about the easement area, provided that Grantor has done <br />all of the following: (a) notified Grantee at least 24 hours prior to <br />excavating or digging within 5 feet of the permanent easement strip; <br />(b) permitted Grantee's representative to enter Grantor's lands to <br />locate the cable or other facilities, and permitted Grantee's representa- <br />tive to be present during the digging and excavation, and (c) has avoided <br />excavating or digging directly where Grantee's representative has <br />identified the cable or other facilities to be located; or, if that is <br />not feasible, followed Grantee's representative's reasonable suggestions <br />(such as hand excavation) to avoid damage to the cable or other facili- <br />ties. The notice required under (a) above may be given directly to <br />Grantee by calling (toll -free or collect) at (800) 328 -6039 or such <br />other replacement number provided by Grantee to Grantor. <br />t <br />
