Site to perform any of the provisions of this Agreement. which a <br />defaulting Owner has failed to perform. <br />2.02. Unimpeded Accesp. The Owners agree that no <br />00 barricade or other divider will be constructed between the Sites <br />and the Owners will do nothing to prohibit or discourage the <br />V4 free and uninterrupted flow of vehicular or pedestrian traffic <br />t throughout the Site in the areas designated for such purpose by <br />the owner of each Site; provided that each Owner will have the <br />Go <br />right to temporarily erect barriers to avoid the possibility of <br />dedicating such areas for public use or creating prescriptive <br />rights therein. Nothing contained herein shall prohibit Shopko <br />from maintaining an outdoor lawn and garden area in the common <br />Area as designated on the Site Plan. <br />ARTICLE III <br />Nature of Easements and Rights Granted <br />3.01. Each and all of the easements and rights <br />granted or created herein are appurtenances to the affected <br />portions of the Entire Parcel and none of the easements and <br />rights may be transferred, assigned or encumbered except as an <br />appurtenance to such portions.
