87-- 105313 <br />�. <br />be contested by the Mortgagor or the Lessor with <br />diligence and in good faith, by appropriate legal <br />proceedings and in full compliance with all of the <br />requirements of the Lease with respect to such contests <br />and non - compliance therewith shall not risk the <br />imposition of a fine or penalty against Mortgagee. <br />§2.5. Insurance. <br />Mortgagor shall carry, for the mutual benefit of <br />the Mortgagee, the Lessor and the Mortgagor as their <br />interests may appear, with respect to the Property and <br />its use, such insurance as is required by the Lease. <br />The Mortgagor may effect for its own account any <br />insurance not required under the provisions of this <br />Mortgage, or the Lease, but any insurance effected by <br />the Mortgagor on the Property, whether or not required <br />under this Mortgage, or under the Lease, shall be for <br />the mutual benefit of the Lessor, Mortgagor and <br />Mortgagee and shall be subject to all other provisions <br />of this Mortgage and of the Lease. <br />All policies for insurance evidencing such <br />insurance shall provide: <br />(1) that all insurance shall name the <br />Mortgagee as additional insured party and further, <br />that all insurance, except for public liability <br />coverage (and any other coverage the Mortgagee may <br />determine or which may excepted by the Lease), <br />shall be first payable to the Mortgagee and the <br />Lessor, as their respective interests may appear, <br />and that any loss thereunder payable to the <br />Mortgagee and the Lessor, as their respective <br />interests may appear, shall be payable <br />notwithstanding any act or negligence of the <br />Mortgagor, as Lessee, or of any sublessee or other <br />occupant of any portion of the Property which <br />would otherwise result in a forfeiture of such <br />insurance, and that in no event shall such policy <br />be cancelled without at least ten (10) days' prior <br />notice to the Mortgagee and the Lessor; and <br />J <br />h <br />
