87--' 105311 <br />-3- <br />additional rent and other payments required to be paid <br />by the Lessee under the Lease and (b) all real estate <br />taxes, assessments, water and sewer rates and charges, <br />and all other governmental levies and charges (the <br />"Impositions "), of every kind and nature whatsoever, <br />general and special, ordinary and extraordinary, <br />unforeseen as well as foreseen, which shall be <br />assessed, levied, confirmed, imposed or become a lien <br />upon or against the Property or any portion thereof, or <br />which shall become payable with respect thereto. To <br />the extent that the Lease shall grant to the Mortgagor, <br />as Lessee thereunder, the privilege to postpone or <br />defer the payment of any such Imposition, or any <br />additional rent or other payment other than basic rent, <br />the failure of the Mortgagor to pay the same shall not <br />constitute an Event of Mortgage Default if and so long <br />as (i) the Mortgagor shall faithfully comply with all <br />of the conditions and other requirements of the Lease <br />with respect to the exercise of such privilege and (ii) <br />there does not exist any substantial danger of sale, <br />forfeiture or loss of the Mortgagor's or Mortgagee's <br />interest in the Property, and (iii) the Mortgagor <br />shall, at the Mortgagor's option, provide security <br />satisfactory to the Mortgagee, assuming the discharge <br />of the Mortgagor's obligations hereunder and of any <br />additional charge, penalty or expense arising from or <br />incurred as a result of postponing or deferring payment <br />of any Imposition. <br />§2.3. Maintenance and Repairs, Additional <br />Security. To the extent the Lessor is not required to <br />do so pursuant to the terms of the Lease, the Mortgagor <br />will keep and maintain or cause to be kept and <br />maintained all buildings, Building Service Equipment <br />and other improvements now or at any time hereafter <br />erected upon or constituting any portion of the <br />Property, and the sidewalks and curbs abutting the <br />same, in reasonably good order and condition and in a <br />rentable and tenantable state of repair (reasonable <br />wear and tear excepted), and to the extent required by <br />the Lease will make or cause to be made, as and when <br />the same shall become necessary, all structural and <br />non- structural exterior and interior, ordinary and <br />extraordinary, foreseen and unforeseen repairs, <br />renewals and replacements necessary to that end. In <br />the event that the Property shall be damaged or <br />destroyed, in whole or in part, by fire or any other <br />casualty, or in the event of a taking of a portion of <br />the Property as a result of any exercise of the power <br />of eminent domain (hereinafter in this Mortgage called <br />
