87_ 104613 <br />Nebraska , containing approximately 135 acres, more or less, <br />including a large lake, as well as any other part of Section <br />Six (6) owned by it and not sold under the terms of the <br />parties' described Contract, as well as any part of Section <br />Six (6) above described which First Party may hereafter <br />acquire at any time and in any manner, shall be subject to <br />the following covenants, conditions and restrictions for the <br />use, occupancy and development of said property: <br />A. All of said property shall be used for <br />residential purposes, except as hereafter .set <br />forth. <br />B. All construction on any lots in said above <br />described Section Six (6) by First Party now <br />owned by it, and not sold under the terms of <br />the parties' described Agreement, or later <br />acquired by it, shall be residential, <br />single- family dwellings, and accessory uses <br />customarily incidental thereto. <br />C. There shall be no construction of condo- <br />miniums, duplexes or other multi - family units <br />or apartments of any kind on lots or any part <br />of the property hereinabove described, <br />provided nothing herein shall prevent <br />time -share arrangement or other types of <br />multiple ownership of residential <br />single - family properties or interests in such <br />property. <br />D. All construction on any lots in Section Six <br />(6) shall be generally consistent with the <br />architecture and development presently <br />existing in the area. <br />E. There shall be no commercial hunting on any <br />part of the property above described owned by <br />First Party and not sold under the parties' <br />Contract, as well as any part of Section Six <br />(6) hereafter acquired by First Party, and <br />only hunting of migratory birds by the owners <br />or long -term lessees of property within the <br />described property and their immediate <br />families and guests shall be allowed. <br />F. There shall be no commercial or business use <br />or activities conducted on any part of the <br />described property herein except as follows: <br />(1) First Party may continue to produce <br />gravel and other material from its <br />property. <br />- 2 - <br />a <br />
