87_ 104613 Nebraska , containing approximately 135 acres, more or less, including a large lake, as well as any other part of Section Six (6) owned by it and not sold under the terms of the parties' described Contract, as well as any part of Section Six (6) above described which First Party may hereafter acquire at any time and in any manner, shall be subject to the following covenants, conditions and restrictions for the use, occupancy and development of said property: A. All of said property shall be used for residential purposes, except as hereafter .set forth. B. All construction on any lots in said above described Section Six (6) by First Party now owned by it, and not sold under the terms of the parties' described Agreement, or later acquired by it, shall be residential, single- family dwellings, and accessory uses customarily incidental thereto. C. There shall be no construction of condo- miniums, duplexes or other multi - family units or apartments of any kind on lots or any part of the property hereinabove described, provided nothing herein shall prevent time -share arrangement or other types of multiple ownership of residential single - family properties or interests in such property. D. All construction on any lots in Section Six (6) shall be generally consistent with the architecture and development presently existing in the area. E. There shall be no commercial hunting on any part of the property above described owned by First Party and not sold under the parties' Contract, as well as any part of Section Six (6) hereafter acquired by First Party, and only hunting of migratory birds by the owners or long -term lessees of property within the described property and their immediate families and guests shall be allowed. F. There shall be no commercial or business use or activities conducted on any part of the described property herein except as follows: (1) First Party may continue to produce gravel and other material from its property. - 2 - a
