87-- 164244 <br />AGREEMENT BETWEEN ADJOINING OWNERS CREATING EASEMENT <br />AGREEMENT made July » , 1987, between Benjamin M. Somer <br />and Phyllis J. Somer, husband and wife, of Grand Island, <br />Nebraska, First Parties, and Marlin D. Engleman and Ida M. <br />Engleman, husband and wife, of Grand Island, Nebraska, Second <br />Parties. <br />1. RECITALS. <br />1.1 First Parties are the owners of Lot Two (2), Block <br />Seventeen (17), Kernohan & Decker's Addition to the City of Grand <br />Island, Nebraska, as surveyed, platted and recorded. <br />1.2 Second Parties are the owners of Lot One (1), Block <br />Seventeen (17), Kernohan & Decker's Addition to the City of Grand <br />Island, Nebraska, as surveyed, platted and recorded. <br />1.3 As shown by the plat of Charles B. Beer, Licensed <br />Surveyor No. 192, a copy of which is attached, marked "Exhibit A" <br />and incorporated by reference, there is a one -foot overhang of <br />the west side of the garage located on the lot owned by Second <br />Parties onto the lot owned by First Parties and there is a 0.2 <br />feet encroachment over the northerly 73.1 feet of the lot owned <br />by Second Parties onto the lot owned by First Parties. <br />1.4 The overhang of the garage and the encroachment onto <br />the northerly 73.1 feet of the lot owned by First Parties were in <br />existence before Second Parties became owners of the lot owned by <br />them by a Survivorship Warranty Deed filed of record on March 17, <br />1986, recorded as Document No. 86- 101291 in the Office of the <br />Register of Deeds of Hall County, Nebraska. <br />1.5 For enabling Second Parties to sell the lot owned by <br />them First Parties have agreed to grant to Second Parties, for <br />the consideration of One Dollar ($1.00), an easement for the one - <br />foot overhang of the garage and 0.2 feet encroachment onto the <br />northerly 73.1 feet of the lot owned by First Parties shown in <br />attached "Exhibit A ". <br />2. AGREEMENT. <br />2.1 In consideration of one Dollar ($1.00) received from <br />Second Parties by First Parties, receipt acknowledged, First <br />Parties grant and convey, perpetually, an easement for the one- <br />foot overhang of the west side of the garage constructed on the <br />lot owned by Second Parties overhanging the lot owned by First <br />Parties and the 0.2 feet encroachment over the northerly 73.1 <br />feet of the lot owned by First Parties for enabling Second <br />Parties and their successors in interest to maintain the overhang <br />of the garage and the encroachment onto the northerly 73.1 feet <br />of the lot owned by First Parties as shown on the plat attached <br />as "Exhibit A." <br />In <br />
