87- 10035 <br />names, and proposes to cause the plat of such subdivision when <br />finally approved by the Regional Planning Commission and the City <br />Council to be acknowledged by such owners, certified as to <br />accuracy of survey by a registered land surveyor, and to contain <br />a dedication of the easements to the use and benefit of public <br />utilities and of the streets to the use and benefit of the public <br />forever. In consideration of the acceptance of the plat of said <br />PARK GARDENS THIRD SUBDIVISION, the Subdividers hereby consent <br />and agree with the City of Grand Island, Nebraska, that they will <br />install or provide at their expense the following improvements: <br />1. Residential Development. The proposed subdivision <br />constitutes a planned unit development, pursuant to Section 36 -27 <br />of the Grand Island City Code. For that reason, the Subdividers <br />agree that the continuing requirements of Section 36 -27 of the <br />Grand Island City Code pertaining to residential development <br />under the planned unit development will be complied with by the <br />Subdividers. <br />2. Streets. The Subdividers waive the right to object to <br />any paving or repaving districts of Stolley Park Circle where it <br />abuts the subdivision. <br />3. Water. Public water service is available to the sub- <br />division and the Subdividers agree to connect each unit in the <br />subdivision with a separate line to the public water service <br />before applying for an occupancy permit. <br />2 <br />I <br />I <br />
