<br />: , <br /> <br />200801038 <br /> <br />WHEREAS, the Crane Trust takes no position as to the specific <br /> <br />location of the South boundary line of the Gloe/Trustee Alexander <br /> <br />Land, except to the extent that such boundary line, or any portion <br /> <br />thereof, is one and the same as some part or all of the North <br /> <br />boundary line of the Crane Trust Land; and <br /> <br />WHEREAS, a question has arisen between Gloes and Trustee <br /> <br />Alexander, on one hand, and the Crane Trust on the other hand, as <br /> <br />to the location of the North boundary line of the Crane Trust Land; <br /> <br />and <br /> <br />WHEREAS, Gloes, Trustee Alexander and the Crane Trust have <br /> <br />resolved and settled the question as to the location of the North <br /> <br />boundary line of the Crane Trust Land, and desire to reduce their <br /> <br />resolution and settlement to writing. <br /> <br />Aareement <br /> <br />NOW, THEREFORE, Gloes, Trustee Alexander and the Crane Trust <br /> <br />do hereby agree as follows: <br /> <br />1. The recitals set forth above are incorporated herein by <br /> <br />reference, the same as though repeated verbatim. <br /> <br />2. The North boundary line of the Crane Trust Land, insofar <br /> <br />as such boundary line is one and the same as the South boundary <br /> <br />line of the Gloe/Trustee Alexander Land, is the fallowing-described <br /> <br />line: <br /> <br />Commencing at a point where the West line of Government <br />Lot 2 in Section 23, Township 9 North, Range 12 West of <br />the 6th Principal Meridian, Hall County, Nebraska, <br />intersects the southerly right-of-way line of U.S. <br />Interstate Highway 80, and assuming the West line of <br /> <br />3 <br />
