<br />t ~ r' <br /> <br />200800809 <br /> <br />WHEREAS, TNC is the owner of record of the following-described <br /> <br />real estate: <br /> <br />(a) Government Lot 6 in Section 18, Township 9 North, Range <br />11 West of the 6th Principal Meridian, Hall County, <br />Nebraska, and that portion of Government Lot 1 in Section <br />19, Township 9 North, Range 11 West of the 6th Principal <br />Meridian, Hall County, Nebraska, which is located north <br />of Denman Road, said Government Lot 1 being located in <br />the northern half of said Section 19; and <br /> <br />(b) All Platte River accretion lands deriving from and <br />adjacent to Government Lot 6 in Section 18, and <br />Government Lot 1 in Section 19, all in Township 9 North, <br />Range 11 West of the 6th Principal Meridian, Hall County, <br />Nebraska, said Government Lot 1 being located in the <br />northern half of said Section 19 <br /> <br />(all of such real estate being hereinafter collectively referred to <br /> <br />as "the TNC Land"); and <br /> <br />WHEREAS, the government lots constituting a portion of the <br /> <br />Gloe/Trustee Alexander Land are located to the northwest of the <br /> <br />government lot and part of a government lot constituting a portion <br /> <br />of the TNC Land; and <br /> <br />WHEREAS, a portion of the Gloe/Trustee Alexander Land does or <br /> <br />may abut the TNC Land; and <br /> <br />WHEREAS, Gloes and Trustee Alexander, as the parties <br /> <br />plaintiff, have commenced an action in the District Court of Hall <br /> <br />County, Nebraska, bearing Case No. CI 06-832, wherein TNC and <br /> <br />others are named parties defendant (such action being hereinafter <br /> <br />referred to as "the Boundary Line Suit"); and <br /> <br />WHEREAS, Gloes and Trustee Alexander, in the Boundary Line <br /> <br />Suit, seek, among other things, to have the South boundary of the <br /> <br />Gloe/Trustee Alexander Land determined; and <br /> <br />2 <br />
