<br />200800668 <br /> <br />and (v) neither permitting nor committing any unauthorized secondary financing <br />or transfers of the Property. <br /> <br />2. The Purchaser agrees that there shall be full compliance with the provisions of (a) <br />any laws prohibiting discrimination in housing on the basis of race, sex, color, <br />creed, national origin, familial status or handicap; and (b) the Secretary's <br />regulations providing for nondiscrimination and equal opportunity in housing. It <br />is understood and agreed that failure or refusal to comply with any such <br />provisions shall be a proper basis for the Secretary to take any corrective action he <br />may deem necessary, including, but not limited to, the rejection of future <br />applications for FHA mortgage insurance and the refusal to enter into future <br />contracts of any kind with which the Purchaser is identified; and further, the <br />Secretary shall have a similar right of corrective action with respect to (i) any <br />individuals who are officers, directors, principal stockholders, trustees, managers, <br />partners or associates of the Purchaser; and (ii) any corporation or any other type <br />of business association or organization with which officers, directors, principal <br />stockholders, trustees, managers, partners or associates of the Purchaser may be <br />identified. <br /> <br />3. Nothing herein contained shall in any way impair the Mortgage, Note, Security <br />Agreement or any other security instrument now held for said indebtedness, or <br />alter, waive, annul, vary or affect any provision, condition or covenant therein, <br />except as herein provided. Except as otherwise specifically provided herein, <br />Holder and Purchaser will be bound by, and comply with, all the terms and <br />provisions of the Mortgage, Note, Security Agreement and any security now held <br />for said indebtedness, as amended by this Agreement. <br /> <br />4. The Seller of the Property shall be and is hereby released as of the effective date <br />of this Agreement, from all liability for obligations and responsibilities under the <br />Assumption Documents assumed by Purchaser, whether financial or otherwise. <br /> <br />5. The effective date of this Agreement shall be the date of transfer of the Property <br />from the Seller to the Purchaser. <br /> <br />3 <br />
