<br />" <br /> <br />.. <br /> <br />200800668 <br /> <br />assumed by the Seller pursuant to an Assumption Agreement executed on June 30, 2000 <br />and recorded at Instrument Number 200006300 in the aforesaid records. <br /> <br />WHEREAS, the Note, Mortgage, and Security Agreement were assigned by the <br />Original Lender to the Lender pursuant to the Assignment dated July 31, 2006, executed <br />by the Original Lender as assignor and recorded at Instrument Number 200610411 in the <br />aforesaid records on November 1, 2006 and pursuant to the Assignment dated July 31, <br />2006 executed by the Original Lender as assignor and recorded at Instrument Number <br />200706780 in the aforesaid records on August 8, 2007. <br /> <br />NOW, THEREFORE, in consideration of the sale of the Property from Seller to <br />Purchaser and for other good and valuable consideration, the receipt, adequacy and <br />sufficiency of which are hereby acknowledged, and in order to comply with the <br />requirements of the Secretary, the NHA, and the regulations adopted pursuant thereto, <br />Purchaser agrees to assume, except as limited below, and to be bound by the Mortgage, <br />Note, Security Agreement, the Regulatory Agreement and the Use Agreement (together, <br />the" Assumption Documents") as follows: <br /> <br />1. Purchaser does not assume personal liability for payments due under any of the <br />Assumption Documents or for the payments to the reserve for replacements <br />pursuant to the Regulatory Agreement or tor matters not under its control, <br />provided that the Purchaser shall remain liable under said Regulatory Agreement <br />only with respect to the matters hereinafter stated, namely: <br /> <br />(a) For funds or property of the Property coming into its hands which, by <br />the provisions thereof, it is not entitled to retain; and <br /> <br />(b) For its own acts and deeds, or acts and deeds of others which has <br />authorized in violation of the provisions thereof. <br /> <br />Purchaser shall be bound by said Assumption Documents subject to the foregoing <br />limitations of personal liability from and after the effective date of this Agreement <br />to the same extent as if it had been an original party to said instruments and <br />accepts and agrees to perfonn all of the obligations of Seller under and pursuant <br />to the Mortgage, including but not limited to, (i) permitting inspections of the <br />Property, (ii) providing tax identification numbers, (iii) keeping the Property in <br />good repair, (iv) neither allowing nor committing any waste or nuisance thereon, <br /> <br />2 <br />
