(fl (J) -I N) ^ rv -", ""- P. <Jl 0 I-' ---- ---- -..J (f) c..o (f) f ~~ 'l8 -1(") ,~~: m l DEED OF DISTRIBUTION ROY STOLTENBERG AND EDWARD STOLTENBERG, CO-PERSONAL REPRESENTATIVES OF THE ESTATE OF MARVIN STOLTENBERG, DECEASED (Hall County Court Case No. PR07-159), Grantors, convey and release, subject to easements, liens and all other restrictions of record, the following described real estate in Hall County, Nebraska: /0. ~O The South Half of the Northeast Quarter (S~NE~) in Section Twenty-four (24), Township Twelve (12) North, Range Eleven (11), West of the 6th P.M., Hall County, Nebraska, as follows: (a) To Decedent's daughters, Judy Humiston and Joyce Taylor, a joint life estate while both of them are alive and a sole life estate in the survivor of the two (2) of them until that survivor dies, and (b) Upon the death of the second to die of Judy Humiston and Joyce Taylor the remainder interest shall pass and descend as follows: (i) One-half (~) in shares determined by right of representation to the issue of Judy Humiston who survive her, and (ii) One-half (~) in shares determined by right of representation to the issue of Joyce Taylor who survive her. The life estates granted in this Deed of Distribution are subject to the rights and obligations of their brother, Roy Stoltenberg, to farm the real estate until January 6, 2009 and in lieu of rent to pay 2008 taxes and to pay the balance of the debt secured by the pivot system located upon the real estate and are subject to the following provisions of Decedent's Will: A. My daughters or the Personal Representative of the second of them to die shall have the duty to pay the real estate taxes upon the real estate during their lifetimes for all years in which they or the estate of the second of them to die are entitled to receive the income from the real estate. B. My daughters, jointly, shall have the sole and exclusive right of use, possession, and income of the real estate during their lifetimes just as though they owned the real estate outright. After the death of the first of them to die, the survivor of the two of thelli shall have the sole and exclusive right of use, possession, and income of the real estate during the remainder of her life. C. My daughters shall use their own good judgment concerning the making of repairs and maintaining the fences and ether improvements upon the real estate, but no owner of any 1
