<br />200709536 <br /> <br />5.2 Repair or Restoration Necessitated bv Owner. Each owner shall be liable to the Association to the <br />extent provided for by Nebraska law, for any damage to the common elements or the improvements, <br />landscaping or equipment thereon which results from the negligence or willful conduct of the owner or the <br />owner's family, employees, guests and invitees. The cost to the Association of any such repair, maintenance or <br />replacements required by such act of an owner or the members of his family, guests or invitees, shall be paid for <br />by said owner, upon demand, to the Association. The Association may enforce collection of such amounts in <br />the same manner and to the same extent as provided for in this Declaration for the collection of assessments. <br /> <br />5.3 Association's Right of Access. Each owner hereby grants to the Association a right of access to the <br />common elements for the purpose of enabling the Association to exercise and discharge its powers, duties and <br />responsibilities under this Declaration. This right of access shall include, without limitation, the right to enter <br />upon the common elements for the purpose of determining whether the provisions of this Declaration are being <br />complied with by the unit owners, family members, guests and invitees, tenants and licensees. The Association <br />shall have the right to enter a unit in case of emergency. <br /> <br />ARTICLE VI. <br /> <br />THE ASSOCIATION <br /> <br />6.0 Rights, Powers. and Duties of the Association. The Association shall be an unincorporated <br />association, and shall have such rights, powers and duties as are prescribed by the Condominium Act and as are <br />set forth in this Declaration, together with such further rights, powers and duties as may be reasonably <br />necessary to effectuate the objectives and purposes of the Association as set forth herein. <br /> <br />6.1 Directors and Officers. The affairs of the Association shall be conducted by an Executive Board <br />and such officers and committees as the Directors may elect and appoint, in accordance with this Declaration <br />and the By-Laws. <br /> <br />6.2 Association Rules. By a majority vote of the Executive Board, the Association may, from time to <br />time and subject to the provisions of this Declaration, adopt, amend and repeal rules and regulations. The <br />Association Rules, may, among other things, restrict and govern the use of any area by any owner, by the family <br />of such owner, or by an invitee, licensee or lessee of such owner; provided however, that the Association Rules <br />may not unreasonably discriminate among owners and shall not be inconsistent with this Declaration or the <br />Association's By-Laws. A copy of the Association Rules as they may from time to time be adopted, amended <br />or appealed, shall be mailed or otherwise delivered to each Unit Owner and may be recorded in the office of the <br />Hall County Register of Deeds. <br /> <br />ARTICLE VII. <br /> <br />MEMBERSHIP AND VOTING RIGHTS <br /> <br />7.0 Identitv. Each owner of a unit shall be a member ofthe Association. <br /> <br />7.1 Classes of Membership. The Association shall have two classes of voting membership: <br /> <br />7.1.1 Class A. Class A members shall be all owners of units, with exception of the Declarant, until such <br />time as the Class B membership ceases.
