<br />200708774 <br /> <br />Section 6. Fences. Fences are pennitted, subject to the tenns and conditions set forth in Article III, Section <br /> <br />(5)(c). <br /> <br />Section 7. Colors. All paint colors, color combinations and paint schemes shall be subject to the prior <br />approval of the ACe. The ACC has a set of approved colors. Home and garage or carport siding and trim colors shall be <br />selected from these colors. Any repainting of a home or other Improvements with colors, color combinations or a color <br />scheme that differs from that specifically approved by the ACC for such home or other Improvements shall require ACC <br />approval prior to commencement of the work <br /> <br />Section 8. Elevation Facine: Street. The elevation of the home facing the street shall have a minimum of two <br />(2) windows each having minimum dimensions of 30" by 53" or as otherwise approved by the ACC. Windows shall <br />have shutters or trim approved by the ACC. <br /> <br />Section 9. Accessory Structures. All accessory structures, such as garages, carports, porches, decks and <br />storage buildings, shall be either integrated to the home or designed to be compatible. Compatibility shall be judged <br />solely by the ACC. Other than Improvements initially provided to an Owner by Declarant, the minimum <br />requirement for the size of the rear deck is 4' x 4'. No outhouse, tent, trailer, or any temporary structure shall be <br />erected or maintained on. any Lot. Front decks not considered a porch by ACC are prohibited. <br /> <br />Section 10. Site Orientation. The Owner shall submit a site plan showing the home and all accessory structures <br />to the ACC for approval prior to any construction. <br /> <br />Section 11. Air Conditioning Systems. The installation and operation of central air-conditioning units must <br />be approved by the ACC prior to installation. Air conditioning systems, evaporative cooler systems and air circulators <br />shall be installed so that no part of the system is visible from the street unless otherwise approved by the ACC, <br />Central air conditioning units must be located on a solid concrete slab in an inconspicuous area, and must be <br />installed according to applicable laws and requirements. Window air conditioning systems must be braced to the <br />home. No bracing such as pole supports to the ground are pennitted. Window air conditioning units shall be <br />placed in a window not visible from the street unless approval for the same is obtained in writing from ACe. Central <br />air conditioning will require local penn its. A copy of the building penn it, contractor's license and insurance must be <br />submitted to the ACC upon its request for the same. <br /> <br />Section 12. Transportation System Removal. The systems required to move the factory-built modular <br />home sections to the Lot shall be removed as promptly as possible following delivery on to the Lot. <br /> <br />Section 13. Antennas and Satellite Dishes. No roof-mounted, ground-mounted or other antennas are allowed <br />to be placed on any Lot without the prior consent of the ACC in accordance with Article BI, Section 1 above; provided, <br />however that if the ACC has not approved or disapproved plans for any antenna or satellite dish within ten (10) days <br />after receipt of proper notice, such plans shall be deemed to be approved. In implementing the provisions of this Section, <br />the ACC may not take any action that would violate the requirements of 47 C.F.R. Section 1.4000, as same may be <br />amended from time to time. Notwithstanding the foregoing, however, by accepting a deed to any Lot, each Owner <br />covenants and agrees that he or she will not bring any action, claim or suit for damages against the Association, any <br />member(s) of the Board of Directors or of the ACC, or Declarant, for any acts taken, or for any failure to take action, <br />in reviewing and approving, disapproving or conditionally approving any matters pursuant to this Section 13. Rather, <br />the sole and exclusive remedy that any Owner may obtain for any violation of said regulations, or of any other legal <br />requirements pertaining to antennas or satellite dishes, shall be an action for specific perfonnance to require the approval <br />of the placement of the same on the Lot in question. Back yard inconspicuous satellite dish installations are pennitted, <br />provided that all wiring is buried. <br /> <br />Section 14. Patios and Decks. Detailed plans and specifications for any patio or deck must be submitted in <br />writing to the ACC. No construction shall commence until the ACC has given written approval of such plans and <br />specifications. <br /> <br />Section 15. Set-up Requirements. All homes must be set up according to the home builder's specifications <br />and at grade. All home set-up and installation shall be perfonned in accordance with all Laws. <br />
