Any lien created in favor of Declarant pursuant to this Section 9 shall be subordinate to the lien <br />of any mortgage or deed of trust recorded prior to the Lien Notice, but shall be senior to any homestead exemption as <br />now or hereafter may be provided by Nebraska law, and this clause shall constitute a waiver of such homestead. Any <br />lien created in favor of Declarant pursuant to this Section 9 may be enforced by the foreclosure of the lien <br />encumbering the real property, including the Improvements on the real property, in like manner as a mortgage on real <br />property is foreclosed under the laws of the State of Nebraska. In any such foreclosure action, the breaching or <br />defaulting Owner shall be required to pay Declarant an administrative fee of$75.00. Every Owner accepting a deed to <br />a Lot acknowledges and agrees that the costs and damages that will be incurred by Declarant in connection with Declarant's <br />remedy of an Owner's breach will be difficult if not impossible to ascertain, and agrees that such fee is a reasonable <br />estimate of such costs and damages. In addition to such administrative fee, a defaulting Owner shall also be required <br />to pay all costs, expenses and reasonable attorneys' fees incurred by Declarant in connection with the filing and releasing <br />of the Lien Notice and in connection with the foreclosure, and such amounts shall be secured by the lien evidenced by <br />the Lien Notice. Declarant shall have the right and power to bid on the real property, including the Improvements, <br />being foreclosed upon. The indebtedness referenced in the Lien Notice also shall be the personal and individual debt of <br />the breaching or defaulting Owner, and suit to recover a money judgment may be maintained without foreclosing or <br />waiving any lien securing the same. <br /> <br />Section 10. Power to Adoot Rules and Regulations. The Association may adopt, amend, repeal and enforce <br />such Rules and Regulations as may be deemed necessary or desirable with respect to the interpretation and <br />implementation of this Declaration, the operation of the Association, and the use of any of the Property, including Lots. <br />Any such Rules and Regulations shall be reasonably and uniformly applied. Rules and Regulations shall be effective <br />only upon adoption by resolution of the Board of Directors. Written notice of the adoption, amendment or repeal of any <br />Rule or Regulation shall be posted at the Association office, and copies of the effective Rules and Regulations shall be <br />made available to each Owner upon request and payment of the copying cost. Each Owner shall comply with such <br />Rules and Regulations. Rules and Regulations shall have the same force and effect as if they were set forth in and were <br />part of this Declaration. In the event of conflict between the Rules and Regulations and the provisions of this <br />Declaration, the provisions of this Declaration shall prevail. <br /> <br />Section 11. Power to Enforce Rules and Regulations. The Association shall have the power to enforce the <br />provisions of this Declaration and of the Rules and Regulations, and shall take such action as the Board deems <br />necessary or desirable to cause compliance by each Owner. <br /> <br />ARTICLE IV <br /> <br />ARCHITECTURAL STANDARDS <br /> <br />Section 1. Home Size. Homes shall contain a minimum square footage, exclusive of garages, porches, <br />terraces or other accessory structures, of 950 square feet of fully enclosed living area. Homes shall consist of a <br />minimum oftwo (2) factory-built sections. <br /> <br />Section 2. Roof Pitch. The roof pitch for homes shall be at least a 6/12 pitch. <br /> <br />Section 3. Roofmg Material. The roof material shall be of composition asphalt shingles or other material <br />approved by the ACC. The roof shall be of a color to complement the home as determined by the ACC. <br /> <br />Section 4. Home Siding.. The siding of the home and garage or carport shall be of hardboard, vinyl or other <br />material approved by the ACe. Lap sidings shall have a maximum exposure of 8 inches oflap. <br /> <br />Section 5. Foundation Fascia. The foundation fascia between the bottom of the home and the ground shall be <br />of similar color or material as the home siding or another material approved by the ACC. The home shall be set at <br />grade, and the Lot shall be backfilled against the home as close to the bottom of the home as is allowed by applicable <br />FHA or V A regulations so that as little foundation as possible is visible; provided, however, that the foundation may <br />remain visible on one end of the home to the extent necessary to provide access to utilities under the home. Access to <br />utilities under the home shall be screened by landscaping to be as unobtrusive as possible, and shall be as far from the <br />street as reasonably possible. Any door or other access to the utilities under the home shall remain closed and secured <br />when not in use. <br />
