<br />200706761 <br /> <br />~ <br /> <br />6. SIZE: The ground floor area of the main structure exclusive of open porches and <br />garages shall not be less than: <br /> <br />A. One Thousand (I300)square feet for a one story dwelling. <br /> <br />8. Seventeen hundred fifty (1750) square feet for split level dwellings. <br /> <br />C. Eight hundred fifty (950) square feet on the main floor in the case of a <br />one and one half Story, two or two and one-half story structures. <br /> <br />7. MODULAR CONSTRUCTION: All homes must be stick~built on site. No sections, <br />halves, or transporting of homes onto site will be permitted. <br /> <br />8. GARAGE AND BASEMENT: All houses will have a 2-car attached garage and full <br />basement. <br /> <br />9. DRAINAGE AND WATERWAYS: All drainage ditches and waterways constructed <br />on individual lots will not be changed in any way or form. Any changing, filling, or <br />modifying in any way will constitute a breach of these covenants and will allow either the <br />City, its"s representatives, or the developer and/or his representatives to enter the property <br />and make the necessary corrections to the drainage at the landowners expense. <br /> <br />10. UTILITY AND PAVING ASSESSMENT: The initial Sewer, Water, and Paving <br />assessments are included in the price of the Lot. The utility stubs, sewer and water <br />although normally considered in the initial cost are not guaranteed due to changes of <br />policy by the utility companies. <br /> <br />11. SALES AND LEASES: All sales or leases oClots in this subdivision shall be made <br />subject to these restrictions. <br /> <br />12. MOWING AND LOT UPKEEP: All owners are responsible for the upkeep (mowing <br />spraying etc.) Of each lot purchases. In the event the owner neglects the upkeep of the lot <br />the Developers will have the authority to hire an independent contractor and the <br />bill will be sent to the Lot owner. A 12 inch rule is in effect. If the growth is above 12 <br />inches the lot will be mowed and the owner will be billed accordingly. <br /> <br />13. YARDS: All lots must have an established yard one year from the date on initial <br />construction. In the event that a homeowner refuses to establish a yard during this time, <br />the Board of Trustees will have the authority to hire an independent contractor to seed and <br />grade the Homeowners yard and the Homeowner will be billed accordingly. <br /> <br />14. TERM: These covenants shall run with the land and shall be binding upon all <br />parties and all persons claiming under them for a period of twenty-five (25) years, after <br />which time said covenants shall be automatically extended for a successive period of ten(lO) <br />years unless an instrument signed by the majority of the owners of the lots has been <br />
