<br />200705493 <br /> <br />guests walk their pets in the median areas of the Properties and promptly remove their pet's <br />excrement in a proper and sanitary manner. <br /> <br />11. SIDEWALKS: All public sidewalks shall be curb sidewalks; and the acceptance <br />of a deed of conveyance by any purchaser or purchasers of any lot or lots shall be and amount to <br />and be construed as consent thereto, and approval of such curb sidewalks. Public sidewalks <br />abutting lots within the properties shall be maintained in good condition and free from obstructions, <br />ice and snow by the lot owner. <br /> <br />12. FENCES AND HEDGES: No fence, hedge, or other obstruction shall be placed <br />closer to the street line than the set-back distances provided for in paragraph 6 above, except for <br />ornamental shrubs or hedges which do not represent an unsafe or hazardous condition in the <br />opinion of the Board of Directors. <br /> <br />13. RECREATIONAL VEHICLES: No recreational vehicle, boat, trailer, motor <br />home or camper ("recreational vehicles") shall be parked or stored upon any lot within the <br />Properties, except within an enclosed structure. Recreational vehicles may be temporarily parked <br />or stored upon the paved driveway area of a lot for a period oftime not to exceed fourteen (14) <br />consecutive days and a total of thirty (30) days per year. No commercial vehicle, construction <br />equipment or farm equipment may be stored on any lot within the Properties, except when being <br />used for construction on the lot. <br /> <br />14. HOMEOWNERS ASSOCIA nON: Every person or entity who becomes a <br />titleholder of a fee or undivided fee interest in any lot or living unit within the Properties shall be a <br />member of the Corporation. However, any person or entity who holds such interest merely as <br />security for the performance of an obligation shall not be a member. The Corporation shall enforce <br />these Restrictive Covenants. Each member of the Corporation, by acceptance of a deed by which the <br />interest requisite for membership is acquired, shall be deemed to covenant to abide by and enforce <br />the provisions of these Restrictive Covenants, which covenants by the members shall be satisfied by <br />the payment of annual and special assessments for the expenses of enforcement incurred by the <br />Corporation. <br /> <br />15. USE AND MAINTENANCE OF COMMONS: Each member of the Corporation <br />shall have the right to use and enjoy the Commons and the responsibility for maintenance. The <br />Corporation shall administer, maintain and/or improve the Commons. Each member of the <br />Corporation, by the acceptance of a deed by which the interest requisite for membership is acquired, <br />shall be deemed to covenant to maintain the Commons, which covenant by the members shall be <br />satisfied by the payment of annual and special assessments for the administration, maintenance or <br />improvement of the Commons. <br /> <br />16. ANNUAL AND SPECIAL ASSESSMENTS: Annual and special assessments for <br />the administration, maintenance or improvement of the Commons, expenses of enforcement of these <br />Restrictive Covenants, or general administration of the Corporation may be levied by the Board of <br />Directors of the Corporation. <br /> <br />4 <br />
