<br />The following-described real estate represents the real estate known as Riverside
<br />Acres and is legally described as:

<br />Lots 2 through 9, Block 1; Lots 1 through 23, Block 2; Lots 1 through 20,
<br />Block 3; Lots 1 through 29, Block 4; Lots 1,2,3, 7, 8 and 9, Block 5; Lots 1
<br />through 6, Block 6; Lots 1 through 5, Block 7, and Lots 1 through 4, Block 8,
<br />Replat of Riverside Acres, Grand Island, Hall County, Nebraska;

<br />The Properties are subject to certain "AGREEMENTS FOR RESTRICTIVE
<br />COVENANTS, RESTRICTIONS AND CONDITIONS FOR 'RIVERSIDE ACRES'"
<br />executed July 27, 1965, by James B. Beltzer and Anita B. Seltzer, husband and wife and
<br />recorded August 27, 1965, in Book 14 of Miscellaneous, Page 394, in the office of the
<br />Register of Deeds for Hall County, Nebraska, as amended by action taken at a general
<br />meeting of the Property owners of the Riverside Property Owners Association January 29,
<br />1985, and recorded March 29,1985, as Document No. 85-001466 in the office of the
<br />Register of Deeds for Hall County, Nebraska.

<br />The undersigned is the Secretary of Riverside Acres Homeowners Association, Inc.
<br />(the Corporation) and by the execution hereof states and affirms that at an annual meeting
<br />of the Corporation held on June 28, 2006, a majority of the owners of the Properties voted
<br />to adopt these Amended and Restated Restrictive Covenants, Restrictions and Conditions
<br />for Riverside Acres (Restrictive Covenants) for the purpose of updating, modifying, and
<br />facilitating enforcement of the common scheme of development of the Replat of Riverside
<br />Acres, and authorizing the incorporation of the Corporation for the purpose of enforcing
<br />these Restrictive Covenants and maintaining the medians in the public street rights-of-way
<br />within the Replat of Riverside Acres, Grand Island, Hall County, Nebraska (Commons).
