<br />200705368 <br /> <br />areas by the parties, Pioneer Trail's contractors will have unlimited access to such areas for <br />purposes of performing the work associated with such items. <br /> <br />Section 5. <br /> <br />Compliance with Laws. <br /> <br />Pioneer Trail agrees that it, its representatives, employees, agents, licensees, invitees, and <br />contractors will present proper credentials when seeking access to the Premises; will comply <br />with all applicable safety and environmental laws and regulations, including Cargill's safety <br />requirements, when on or about the Premises; and as a condition of access to the Premises will <br />participate in Cargill's review of its safety requirements. Pioneer Trail further agrees that Cargill <br />may, at the sole cost and risk of Pioneer Trail, stop work and deny future access to the Premises <br />to any person or entity for failure to comply with applicable safety and environmental laws and <br />regulations or Cargill's safety requirements, which failure has continued for two (2) consecutive <br />days after notice and demand for cure from Cargill. <br /> <br />Section 6. <br /> <br />Risks and Obli2ations. <br /> <br />Pioneer Trail will conduct the Work at its sole risk and expense. Pioneer Trail will be <br />responsible for and pay all charges made, levied, or assessed by any third party in connection <br />with the Work, including without limitation any charges, licensing fees, and the like, levied <br />against Pioneer Trail or Cargill. <br /> <br />Section 7. <br /> <br />Insurance. <br /> <br />Pioneer Trail and each permitted subcontractor will furnish to Cargill copies of insurance <br />certificates evidencing that it maintains the following coverages or any higher amounts as <br />required by law or regulation: <br /> <br />Types ofInsurance <br /> <br />Limits <br /> <br />Workers' Compensation <br /> <br />Statutory <br /> <br />Employer's Liability <br /> <br />$1,000,000 each occurrence <br /> <br />Commercial General Liability <br />including Contractual Liability <br /> <br />Bodily injury and death: $1,000,000 per occurrence, <br />$2,000,000 annual aggregate <br /> <br />Liability and Automobile Liability <br /> <br />Property damage: $2,000,000 combined single limit <br /> <br />3 <br />
