An undivided one~halfinterest in and to: Lot Five (5), Block Twelve (12), <br />Voitle's Addition to Grand Island, Hall County, Nebraska. <br />2. An undivided one-half interest in and to: Lot Six (6), Block Twelve (12), <br />Voitle's Addition to Grand Island, Hall County, Nebraska. <br />3. That in addition to the above and foregoing deceased Helen C. Martinez <br />and her spouse Carmel Martinez owned the following described property as joint <br />tenants with right of survivorship and not as tenants in common: East 63.5 Feet <br />of Lot One (1), Block Seventy-Two (72), Original Town of Grand Island, Hall <br />County, Nebraska. <br />G. That the Personal Representative has filed an Inheritance Tax Worksheet showing <br />and disclosing that there is no inheritance tax due by virtue of the exempt status of deceased's <br />spouse Carmel Martinez as heir, beneficiary, and sole distributee of deceased's assets, which <br />worksheet discloses a Voluntary Appearance and Waiver of Notice duly executed by the office <br />of County Attorney of Hall County, State of Nebraska. That said worksheet and figures and <br />calculations therein contained are approved by this Court and therefore there is no Inheritance <br />Tax due as a result of deceased's death and any lien that has heretofore existed against the assets <br />of said estate, namely the real estate above described is hereby extinguished and held for naught. <br />H. That the entire market value of deceased's interests in and to the real estate <br />described in Paragraph F1. and F2. above, at the time of deceased's death had a combined <br />market value of $21,475.00 and therefore the value of deceased's estate did not exceed the sum <br />of $50,000.00. That pursuant to Section 30-2302 R.R.S. (1995) and specifically by statutory <br />intestate succession the real estate described in F I. and F2. above passed and descended to <br />deceased's spouse Carmel Martinez, he becoming the sole and only owner as heir and <br />beneficiary of deceased's estate. That the said Carmel Martinez, spouse of deceased departed <br />this life on the 30th day of March, 2004 and therefore the Personal Representative in lieu of <br />distributing the interest of said Carmel Martinez to him is authorized and directed to file a copy <br />of this "Formal Order For Complete Settlement After Informal Intestate Proceeding" in the <br />Register of Deeds office for Hall County, Nebraska, thereby fulfulling the stated purpose of <br />probate as set forth in paragraph 5 above. <br />That deceased's interest in property described in Paragraph F3 above having been owned <br />by deceased and deceased's spouse Carmel Martinez as joint tenants with right of survivorship <br />and not as tenants in common ceased upon her death and the said Carmel Martinez became the <br />owner of the entire interest in said premises by act and operation of law, namely by survivorship <br />as a surviving joint tenant. <br />I. The authority of the Personal Representative shall terminate, and the Personal <br />Representative shall be discharged from further claims or demands from interested persons and <br />the surety on the Personal Representative's bond, if any, shall be released when the following <br />conditions have been met: filing of receipts for Court Costs and attorney fees; and the filing of a <br />statement by the Personal Representative reporting due filing of this Formal Order with the <br />
