MARTINEZ, Deceased. ) <br /> <br />Case No. PR06-203 <br /> <br />REYNALDAACARPENTER <br />CLEHr( rc~AGISTFlATE <br />HALL CO COURT <br /> <br />FORMAL ORDER FOR <br />COMPLETE SETTLEMENT AFTER <br />INFORMAL INTEST ATE PROCEEDING <br /> <br />Upon consideration of the Petition for Complete Settlement of the Personal <br />Representative of this estate, the Court finds and determines that: <br />1. That required notices have been given or waived. <br />2. Decedent died intestate on the 23rd day of October, 1988, and was domiciled in <br />the County of Hall, State of Nebraska. <br />3. On October 3, 2006, Carmelita Perales was duly appointed and qualified as <br />Personal Representative of the estate and has continued to qualify and act as Personal <br />Representative of the estate from time of appointment. The Personal Representative has <br />collected and managed the assets of the estate, filed an Inventory and Final Accounting herein, <br />paid all lawful claims against the estate and performed all other acts required by the laws of the <br />State of Nebraska pertaining to estates of decedents. <br />4. The Decedent was survived by the following named heirs at law related as <br />indicated: Carmel Martinez, Spouse; James Martinez, son; Carmel ita Perales, daughter; Mario <br />Martinez, son; Pamela L. Martinez, daughter; Frank Martinez, son; Russell 1. Martinez, son. <br />5. That this estate proceeding has been belatedly filed primarily for the purpose of <br />curing title defects with respect to real estate described in paragraphs Fl. and F2. below existing <br />by virtue of the fact deceased and deceased's spouse Carmel Martinez owned said property as <br />tenants in common, rather than as joint tenants with right of survivorship. <br />6. That due notice to creditors has been published in compliance with Nebraska <br />Probate Code Section 30-2483 and proof thereof filed herein. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that: <br />A. The findings herein above made should be and they are hereby made a part of the <br />Decree of this Court as fully as if set out at length herein. <br />B. Decedent died intestate. <br />C. The sole and only heirs at law of the Decedent are those listed in the above <br />findings. <br />D. The Final Accounting of the Personal Representative is hereby allowed and <br />approved as filed herein. <br />E. Court costs are due herein in the amount of$105.00. <br />F. That deceased died seized of assets consisting of real estate only, which real <br />
