<br />Corporation, TRUSTEE, upon a Deed of Trust made and entered into on or about September
<br />29,2004, recorded September 30,2004 as Instrument No. 200409670, in the Office of the
<br />Register of Deeds of Hall County, Nebraska, by and between H 0 R TENSIA V. ENRIQUEZ,
<br />a single person, as TRUSTOR, TIERONE BANK, a United States Corporation, as
<br />BENEFICIARY, Assigned to SECRETARY OF HOUSING AND URBAN
<br />DEVELOPMENT, his successors and assignors, by Assignment of Deed of Trust recorded
<br />April 3, 2007 as Instrument No. 200702640, herein called the GRANTOR, in consideration
<br />of Seventy-Four Thousand Two Hundred One and 2 1/ I 00 Dollars ($74,201 .21), and other
<br />valuable consideration received from Grantee, does hereby grant, bargain, sell, convey and
<br />confirm unto SECRETARY OF HOUSING AND URBAN DEVELOPMENT, his
<br />successors and assignors, c/o Best Assets, Inc., Mortgage Compliance Specialists, 501
<br />Marquette Avenue, Suite 1200, Minneapolis, Minnesota 55402, herein called the
<br />GRANTEE, the following described real estate in Hall County, Nebraska:

<br />The Southerly Eighty-two feet (S 82') of Lot Six (6), in Block Four (4), Gilbert's Second
<br />Addition to the City of Grand Island, Hall County, Nebraska, more commonly known as 924
<br />W 15th Street, Grand Island, NE 68801-3610
<br />
<br />TO HAVE AND TO HOLD the above-described premises together with all
<br />tenements, hereditaments and appurtenances thcreto belonging unto the Grantee, and to
<br />Grantee's successors and assigns forever.
<br />
<br />Grantor does hercby covenant with the Grantee and with the Grantee's successors and
<br />
<br />assIgns:
<br />
<br />(1) Hortensia V. Enriquez, a single person, Trustor, failed to pay thc Beneficiary
<br />payments which were contractually due, and the Grantor, at the request ofthe Beneficiary,
<br />elected to declare the entire unpaid principal balance, together with interest thereon, at once
<br />immediately due and payable.
<br />
<br />(2) Notice of Default and Election to Sell was filed by Grantor on January 5, 2007
<br />as Instrument No. 200700123, of the records of the Register of Deeds office of Hall County,
<br />Nebraska. A copy of the Notice of Default and Election to Sell was served upon Hortensia
<br />V. Enriquez; Present Occupant; by certified mail, return receipt requested and first class mail
<br />on January 10,2007.
<br />
<br />(3) Trustor Hortensia V. Enriquez failed to cure the default referenced in the
<br />Notice of Default and Election to Sell within 30 days after the service of the Notice of
<br />Default and Election to Sell.
<br />
<br />(4) Notice of Trustee's Sale was filed and a copy of the Notice of Trustee's Sale
<br />was served upon Hortensia V. Enriquez; Present Occupant; by certified mail, return receipt
<br />requested, and also first class mail on February 12,2007.
