<br />RESTRICTIVE COVENANTS - DUPLEX RESIDENCE
<br />
<br />Whereas, Kevin Woodward Construction and Custom Renovations, Inc., a corporation
<br />organized and existing by and under the laws ofthe State of Nebraska, is the owner in fee of the
<br />following described real estate situated in the City of Grand Island, State of Nebraska:
<br />Lot Three (3), Pleasant View Eighth Subdivision, to the City of Grand Island, Hall
<br />County, Nebraska, and Lot Four (4), Pleasant View Eighth Subdivision, to the City of Grand
<br />Island, Hall County, Nebraska,
<br />Otherwise known as 1037 Sun Valley Boulevard and 1041 Sun Valley Boulevard
<br />respectively; and
<br />Whereas, said owner has constructed on said premises, for sale to various persons, a
<br />single dwelling unit composed oftwo separate residences connected by a division wall between
<br />said residences; and
<br />Whereas, it is the intended by the undersigned to create, in favor of a purchaser of each
<br />residence restrictive covenants to facilitate mutual enjoyment of the premises;
<br />Now therefore, the undersigned Kevin Woodward Construction and Custom Renovations,
<br />Inc., in order to protect each and every purchaser, his successors and assigns, of any lot or parcel
<br />of said premises, the following restrictive covenants that shall run with the land are hereby
<br />created, to wit:
<br />1. Lots Affected: Use of Lots. All Lots in the above-described Real Estate shall be
<br />known and described as residential Lots. No pre-fab, modular, or mobile home shall be placed
<br />on a Lot. No trailer, tent, garage, shack, or other unsightly out-building shall be used on said
<br />real estate as a dwelling at any time, nor shall any structure of a temporary character be used as a
<br />residence. No structure shall be erected, altered, placed, or permitted to remain on any
<br />residential Lot other than one (1) Dwelling with an attached or detached garage and one (1)
<br />outbuilding, which must be complimentary to the design of the house. Any outbuilding shall be
<br />of the same quality and materials of construction as the outside finish and roof of the residential
<br />structure. No commercial or business enterprise shall be conducted or operated on the Lots of
<br />the Real Estate. No residential Lot or Lots shall be divided or split to create smaller building
<br />areas, but residential lots may be combined to establish larger building lots.
<br />2. Pets. No barns, chicken houses or other buildings for the care and housing of
<br />fowl, rabbits or livestock shall be placed, maintained, or used on any Lot, nor shall any fowl,
<br />rabbits or livestock be kept upon any Lot. The breeding of animals or keeping of animals for any
<br />commercial purpose is not allowed. Pets such as dogs or cats are permitted, but shall be
<br />restrained. All dogs and cats shall either be inside the owner's residence or kenneled during the
<br />night hours, being from dusk to dawn.
