<br />200702101 <br /> <br />"ARTICLE III - RENT <br /> <br />3.1 Lessee covenants and agrees to pay monthly rent to Lessor in the <br />amount of Eight Hundred Eighty-Nine and 13/1 00 Dollars ($889.13) for the <br />period commencing August 1, 2006 through December 31, 2006. <br /> <br />3.2 Lessee covenants and agrees to pay monthly rent to Lessor for the <br />remaining lease term calculated as follows: effective as of the first day of January <br />of 2007 and the first day of January of each subsequent calendar year thereafter <br />during the remaining lease term the monthly rent for such calendar year shall be <br />increased by two percent (2%) of the monthly rent due hereunder for the <br />immediately preceding calendar year. <br /> <br />3.3 All rent reserved and payable hereunder shall be paid without prior <br />demand therefore and without any deduction or set-off whatsoever, in lawful <br />money of the United States of America; and shall be payable at the office of the <br />Lessor as set forth in Article XIX below, or at such other place or places as may <br />from time to time be designated in writing by the Lessor." <br /> <br />9. Lessor and Lessee acknowledge that although the monthly rental payments due <br />hereunder are to be increased on a calendar year basis the term of each five (5) year renewal <br />period as provided hereinabove shall remain on a fiscal year basis from June 1 to May 31. <br /> <br />10. ARTICLE XIX - NOTICE AND DEMAND of the Original Lease Agreement as <br />amended by the 1996 Amendment is hereby amended and effective as of the date hereof and <br />hereafter shall read as follows: <br /> <br />"ARTICLE XIX - NOTICE AND DEMAND <br /> <br />19.1 Notices or demands to Lessor shall be effective when mailed to <br />Cindy Braddy, Lessor, by depositing said notice in the U.S. mail by registered or <br />certified mail, return receipt requested, addressed to Lessor at 11832 Utica Way, <br />Westminster, Colorado 80031 or such other place as Lessor may designate from <br />time to time in writing. Notice or demands to Lessee shall be effective when <br />deposited in the U.S. mail by registered or certified mail, return receipt requested, <br />addressed to Lessee at 1808 S. Locust Street, Grand Island, Nebraska 68801 or at <br />such other place as Lessee may designate from time to time in writing." <br /> <br />11. In all other respects and except for the amendments set forth herein the Original <br />Lease Agreement as amended by the 1996 Amendment shall remain unchanged and as written <br />and is hereby ratified and confirmed. <br /> <br />IN WITNESS WHEREOF the undersigned Lessor and Lessee hereto execute this <br />Agreement as of the date and year first above written. <br /> <br />3 <br />
