I-" 8.3 the LESSOR shall be i:lcluded as a named insured under all such policies and a certificate thereof shall be deposited with LESSOR prior to the commencement date of this Lease and a cerUficilte evidencing the renewal of such policies shall be so deposited not less than thirty (30) days prior to their respective expiration dates. 8.4 All such policies shall provide that they are non-cancellable except upon thirty (30) days written notice to the LESSOR. 8.5 It is further agreed by and between th~ parties hereto I that each of said parties hereby waive any and all right of recovery against one another, based upon the negligence of either party, their agents, servants, or empioyees , for real or personai property losS and damage occurring to the premIses I or any part thereof, from perilS insured against in hazard, flre and extended coverage, vandalism and malicious mischief insurance contracts carried by LESSEE- and from any loss, cost, damage or expense whatsoever arising out of any accident 9.1 The LESSEE shall indemnify and save the LESSOR harmless of ARTICLE IX - INDEMNITY AND WAIVER or other occurrence causing injUry to any person or property due directly or 1n- directly to the use of the Leased Premised or any publiC or private propertY adjacent thereto ~JY LESSEE or any person claiming under LESSEE or as the result of any act or omission of the LESSEE, its agents or employeeS or any other person. or buildings and other improvements to be erected as 'herein contemplated and the 9.2 The LESSOR makes no representation with respect to the building LESSEE expresslY excu Ipates the LESSOR of and from any duty to repair with respect to any defects in labor or material used therein and waives any claim as to loss of business or damage to 'property of the LESSEE or others and/or death or injury to any perSon or p~rsons as the result of any such defects.
