That notice of said breach has been <br />given to the defendants, as required by "Exhibit B", and that the <br />defendants have failed to cure the default by the date specified <br />in said notice, whereby said mortgage debt has become absolute <br />and Plaintiff has elected to declare the whole indebtedness due <br />and payable immediately. <br /> <br />VI. <br />That no proceedings at law have been had for the recovery <br />of this debt, or any part thereof, nor has said debt or any part <br />thereof been collected and paid except as above stated; that <br />there is now due upon said note and mortgage, after allowing all <br />possible credits thereon, the sum of Three Hundred Thirty-five <br />Thousand Five Hundred Eleven and 56/100 Dollars ($335,511.56). <br />VII. <br />That the defendant Norwest Bank Nebraska, N.A., formerly <br />known as Norwest Bank Grand'Island, N.A., as Trustee-Beneficiary, <br />may claim some right, title and interest in and to the above <br />described real estate, by virtue of a Trust need in which E. Dean <br />Wolfe and Judith A. Wolfe are Trustors and Norwest Bank Nebraska <br />is Trustee-Beneficiary, said Trust Deed being dated November 26, <br />1984, and filed for record November 30, 19S4, in the office of <br />the Register of Deeds of Hall County, Nebraska, said Trust Deed <br />being in the amount of One Hundred Twenty-seven Thousand and <br />No/lOO Dollars ($127,000.00), and appearing in Document No. 84- <br />006260 of the records in said office.
