<br />88- 104341 <br /> <br />might result in, or permit the creation of, a lien on the <br />Mortgaged property or any part thereof, or on other revenues, <br />rents, issues and incoming profits arising therefrom. <br /> <br />I <br /> <br />1.6 Care of Property. <br /> <br /> <br />Mortgagor will take good care of the Mortgaged Property, and <br />will maintain, repair, replace or restore the same as required to <br />keep the same in as good repair and condition, in any event not <br />less than as at the original date of this Mortgage, ordinary wear <br />and tear excepted, and will commit or permit no waste (the <br />failure to pay taxes, utility, and other charges or to properly <br />protect, use, or insure the Premises also being deemed Pwaste" of <br />the Premises as well as physical waste), and except as provided <br />by written agreement with Mortgagee, will not construct any new <br />buildings, structures or other improvements on the Premises nor <br />add to or alter the design or structural character of any <br />building, structure or other improvement now or hereafter erected <br />upon the Premises nor make any major changes in the use of <br />Mortgaged Property (except as contemplated by the loan agreement <br />between the parties dated even date herewith ) without the prior <br />written consent of Mortgagee and will not remove or permit <br />removal of any of the Mortgaged property nor do any act that <br />would impair or lessen the value of the Mortgaged Property. <br />Mortgagor will promptly comply with all private covenants and <br />restrictions and present and future applicable laws, ordinances, <br />rules and regulations of any governmental authority affecting the <br />Mortgaged Property or the use, maintenance or operation thereof, <br />including specifically without limitation any laws and <br />regulations regarding handicapped persons. Mortgagor shall <br />promptly give Mortgagee written notice of any violation or <br />claimed violation of any covenants, restrictions, laws, <br />ordinances, rules and regulations, and of any material damage or <br />destruction of the Mortgaged property. No fixtures will be <br />installed subject to vendor's lien or other lien except for <br />tenant's trade fixtures for which Mortgagor is not obligated to <br />make any payment thereon. Should any fixture be installed, the <br />lien of this mor.tgage shall immediately attach and be prior and <br />superior to all other liens or claims. <br /> <br />1.7 Right of MortgaQee to Enter. <br /> <br />Mortgagor will permit Mortgagee upon twenty-four (24) hours <br />prior written notice and its agents to enter and to authorize <br />others to enter upon any or all of the Mortgaged Property at <br />reasonable times to ir.spect the same, to perform or observe any <br />covenant, conditions, or terms which Mortgagor shall fail to <br />perform, meet or comply with and which Mortgagee is authorized to <br />perform under the terms of this Mortgage, or for any other <br />purpose in connection with the protection or preservation of <br />Mortgagee's security, without thereby becoming liable to <br />Mortgagor or any person in possession under Mortgagor, subject to <br />rights of tenants under leases. <br /> <br />-7- <br /> <br />LJ <br />
