<br />June 27, 1988, <br />common driveway <br />Exhibit "A" and <br />reference: and <br /> <br />88- 104329 <br /> <br />showing the location of the afore-referenced <br />and common garage, which survey is identified as <br />is attached hereto and made a part hereof by this <br /> <br />WHEREAS, Ingerson and Davis desire to commit to writing an <br />agreement with reference to the use and maintenance of the afore- <br />referenced common driveway and common garage. <br /> <br />NOW, THEREFORE, in cQnsideration of the mutual covenants and <br />conditions contained herein and for other good and valuable con- <br />sideration, the receipt and adequacy of which is hereby acknowl- <br />edged, the parties hereto agree as follows: <br /> <br />1. Ingerson and Davis acknowledge that the facts set forth <br />in the recitals above are true and correct and said recitals are <br />specifically incorporated in this Agreement and made a part of <br />this Agreement by this reference. <br /> <br />2. Ingerson grants to Davis and to his successors in title <br />a perpetual easement over and across the common driveway herein <br />described for the purposes of Davis and his successors in <br />interest in Tract 2 having access for ingress and egress to the <br />common garage herein described and to otherwise have access to <br />the rear of Tract 2, but specifically excluding the right to park <br />vehicles or to otherwise obstruct that portion of the common <br />driveway located on Tract 1. <br /> <br />3. Davis grants to Ingerson and her successors in title a <br />perpetual easement over and across the common driveway herein <br />described for the purposes of Ingerson and her successors in <br />interest in Tract 1 having access for ingress and egress to the <br />common garage herein described and to otherwise have access to <br />the rear of Tract 1, but specifically excluding the right to park <br />vehicles or to otherwise obstruct that portion of the common <br />driveway located on Tract 2. <br /> <br />4. The parties to this Agreement agree that they and their <br />successors in interest in the respective tracts shall share all <br />expenses in maintaining the common driveway herein described. <br /> <br />5. The parties to this Agreement agree that they and their <br />successors in interest in respect to Tract 1 and Tract 2 shall <br />maintain and keep and repair the portion of the common garage <br />located on the respective tLacts owned by each of them and to <br />otherwise keep such garage in neat and clean order and painted <br />when necessary. In addition, the parties to this Agreement agree <br />that they and their successors in interest shall carry fire and <br />extended coverage on their interest in such common garage <br />structure. In the event such common garage becomes damaged, each <br />party shall restore the portion of the common garage located on <br />the tract owned by each of them. <br /> <br />6. This Agreement shall be binding upon the parties to <br /> <br />-2- <br />
