" 1988, by and between BIRDENE INGERSON, a sl.ngle <br />persdn, ereinafter referred to as n Ingerson", and LONNIE D. <br />DAVIS, a single person, hereinafter referred to as "Davis"; <br /> <br />~;;,' <br />'0', <br /><>," <br /> <br />F' <br /> <br />WITNESSTH: <br /> <br />r, <br /> <br />WHEREAS, Ingerson is the owner of a certain parcel of real <br />property described as follows, hereinafter referred to as <br />"Tract 1": <br /> <br />All of the westerly Thirty-Four and Three <br />Tenths (34.3) feet of the southerly Eighty- <br />Seven (87) feet of Lot Eight (8) in Block <br />Seven (7) of Kernohan and Decker's Addition <br />to the city of Grand Island, Hall County, <br />Nebraska; and <br /> <br />WHEREAS, Davis is the owner of a certain parcel of real <br />property described as follows, hereinafter referred to as <br />"Tract 2": <br /> <br />All of the easterly Thirty-One and Seven <br />Tenths (31.7) feet of the southerly <br />Eighty-Seven (87) feet of Lot Eight (8) in <br />Block Seven (7) of Kernohan and Decker's <br />Addition to the City of Grand Island, Hall <br />County, Nebraska; and <br /> <br />WHEREAS, for more than ten (10) years there has been located <br />on Tracts 1 and 2 a common driveway facing Third Street with an <br />approximately 3.4 front footage thereto situated on Tract 1 and <br />with an approximately 3.4 front footage thereto situated on <br />Tract 2; and <br /> <br />WHEREAS, for more than ten (10) years there has been located <br />on Tracts 1 and 2 a common garage, and the entry to that portion <br />of the garage situated on Tract 1 is gained from the South and <br />the entry to that portion of the garage on Tract 2 is now gained <br />from the East; and <br /> <br />WHEREAS, for more than ten (10) years, the owners, occupants <br />and invitees of those in possession of Tracts 1 and 2 have made <br />use of the afore-referenced common driveway and common garage, <br />being located partially on Tract 1 and partially on Tract 2; and <br /> <br />WHEREAS, a survey has been prepared by Lyle W.
