and made a part hereof by this reference~ and WHEREAS, Grantor is willing to grant an easement over, through, under and upon the easement area for the purpose recited herein and upon the terms and conditions as set forth hereinbelow. ~8-10432B NOW, THEREFORE, in consideration of the sum of One and No/lOO Dollars' ($1.00) and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties hereto agree as follows: 1. Grantor hereby grants unto Grantee a perpetual easement and right-of-way over, across, through, upon and un<<:ler the following described real estate for the purpose of installing, maintaining, repairing and replacing an underground sewer line, to-wit: A tract of real estate situated in the North Forty-Five (45.0) feet of Lot Eight (8), Block Seven (7), Kernohan and Deckers Addition to the City of Grand Island, Hall County, Nebraska, and more completely described as a tract of real estate 8.00 feet in width, the centerline thereof being at a point on the South line, 46.0 feet Westerly from the Southeast corner of said North 45.0 feet of Lot Eight (8) and running in a straight line in a northeasterly direction ending at a point on the North line, 38.8 feet Westerly from the Northeast corner of said North 45.0 feet of Lot Eight (8). 2. All costs and expenses in connection with the installation, maintenance, repairing or replacement of said underground sewer line shall be borne solely by Grantee and anyone claiming through Grantee, and Grantor specifically shall have no responsibility or liability whatsoever in connection therewi th. In the event Grantee or anyone claiming through Grantee undertakes any work in connection with installing, maintaining, repairing or replacing said underground sewer line, as permitted herein, said Grantee, or parties claiming through Grantee, shall be solely and completely responsible for causing any of said work tc be performed in a proper and workmanlike manner, and shall further be solely and completely responsible to return the easement area to the sarne condition as the sarne was in immediately prior to such work being commenced. 3. This easement shall be a perpetual easement, shall run with the land, and shall inure to and be binding upon the parties hereto, their heirs, successors and assigns and all parties claiming ownership of Tract 1 or Tract 2 through the parties hereto. -2-
