<br />and made a part hereof by this reference~ and <br /> <br />WHEREAS, Grantor is willing to grant an easement over, <br />through, under and upon the easement area for the purpose recited <br />herein and upon the terms and conditions as set forth <br />hereinbelow. <br /> <br />~8-10432B <br /> <br />NOW, THEREFORE, in consideration of the sum of One and <br />No/lOO Dollars' ($1.00) and other good and valuable consideration, <br />the receipt and adequacy of which is hereby acknowledged, the <br />parties hereto agree as follows: <br /> <br />1. Grantor hereby grants unto Grantee a perpetual easement <br />and right-of-way over, across, through, upon and un<<:ler the <br />following described real estate for the purpose of installing, <br />maintaining, repairing and replacing an underground sewer line, <br />to-wit: <br /> <br />A tract of real estate situated in the North <br />Forty-Five (45.0) feet of Lot Eight (8), <br />Block Seven (7), Kernohan and Deckers <br />Addition to the City of Grand Island, Hall <br />County, Nebraska, and more completely <br />described as a tract of real estate 8.00 feet <br />in width, the centerline thereof being at a <br />point on the South line, 46.0 feet Westerly <br />from the Southeast corner of said North 45.0 <br />feet of Lot Eight (8) and running in a <br />straight line in a northeasterly direction <br />ending at a point on the North line, 38.8 <br />feet Westerly from the Northeast corner of <br />said North 45.0 feet of Lot Eight (8). <br /> <br />2. All costs and expenses in connection with the <br />installation, maintenance, repairing or replacement of said <br />underground sewer line shall be borne solely by Grantee and <br />anyone claiming through Grantee, and Grantor specifically shall <br />have no responsibility or liability whatsoever in connection <br />therewi th. In the event Grantee or anyone claiming through <br />Grantee undertakes any work in connection with installing, <br />maintaining, repairing or replacing said underground sewer line, <br />as permitted herein, said Grantee, or parties claiming through <br />Grantee, shall be solely and completely responsible for causing <br />any of said work tc be performed in a proper and workmanlike <br />manner, and shall further be solely and completely responsible to <br />return the easement area to the sarne condition as the sarne was in <br />immediately prior to such work being commenced. <br /> <br />3. This easement shall be a perpetual easement, shall run <br />with the land, and shall inure to and be binding upon the parties <br />hereto, their heirs, successors and assigns and all parties <br />claiming ownership of Tract 1 or Tract 2 through the parties <br />hereto. <br /> <br />-2- <br />
