<br />88-104328 <br /> <br />EASEMENT AGREEMENT <br /> <br />This Easement Agreement made and entered into this ~ay <br />Of~~ 1988, by and between EQUITABLE BUILDING AND LOAN <br />ASSOC ATION OF GRAND ISLAND, a savings and loan association, <br />hereinafter referred to as "Grantor," and BIRDENE INGERSON, <br />hereinafter referred to as "Grantee." <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Grantor is presently the owner of record of the <br />following described real estate, hereinafter referred to as <br />"Tract I," to-wit: <br /> <br />All of the northerly Forty-Five (45) feet of <br />Lot Eight (8), in Block Seven (7), of <br />Kernohan and Decker's Addition to the City of <br />Grand Island, Hall County, Nebraska; and <br /> <br />WHEREAS, Grantee is presently the owner of record of the <br />following described real estate, hereinafter referred to as <br />"Tract 2," to..;,wit: <br /> <br />All of the westerly Thirty-Four and Three <br />Tenths (34.3) feet of the southerly <br />Eighty-Seven (87) feet of Lot Eight (8), in <br />Block Seven (7), of Kernahan and Decker's <br />Addition to the City of Grand Island, Hall <br />County, Nebraska; and <br /> <br />WHEREAS, presently there is a private sewer system situated <br />on Lot Eight (8), of Block Seven (7), of Kernahan and Decker's <br />Addition to the City of Grand Island, Hall County, Nebraska, <br />wherein sewage from the improvements situated upon Tract 1, <br />Tract 2 and improvements situated upon the following described <br />real estate drains into a common manhole situated on the <br />following described real estate, to-wit: <br /> <br />All of the easterly Thirty-One and Seven <br />Tenths (31.7) feet of the southerly <br />Eighty-Seven (87) feet of Lot Eight (8), in <br />Block Seven (7), of Kernahan and Decker's <br />Addition to the city of Grand Island, Hall <br />County, Nebraska~ and <br /> <br />WHEREAS, to attempt to alleviate some of the present <br />problems with the aforesaid private sewer system, Grantee desires <br />to construct and maintain a sewer line from Tract 2 across <br />Tract 1 to connect directly into the city sewer situated in the <br />alley directly adjacent to the north of Tract 1; and <br /> <br />WHEREAS, a survey has been prepared by Lyle W.
