<br />.,- <br /> <br />-', <br /> <br />88- <br /> <br />10D733 <br /> <br />AMENDED AGREEMENTS FOR RESTRICTIVE COVENANTS, <br />RESTRICTIONS AND CONDITIONS FOR <br />"REGENCY BY THE GREEN" <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />WHEREAS, the undersigned constitute the owners of all <br />lots in "Regency By The Greenll, an addition in the City of <br />Grand Island, Hall County, Nebraska, as more specifically <br />described in the plat of said Subdivision as the same is <br />recorded in the office of the Register of Deeds of Hall <br />County, Nebraska; and <br /> <br />WHEREAS, it is the desire of the aforesaid owners of <br />the lots contained in said subdivision to improve "Regency <br />By The Green" by the sale of lots and encouraging the <br />construction of modern and desirable' dwelling house; and <br /> <br />WHEREAS, it is the desire of the aforesaid owners of <br />lots within the subdivision to ratify and affirm certain <br />covenants created for the subdivision, recorded in the <br />office of the Register of Deeds of Hall County, as Document <br />No. 82-004398, while at the same time making certain <br />additions and changes; <br /> <br />NOW, THEREFORE, in consideration thereof, and of the <br />mutual benefits to be derived by the owners of said lots <br />wi thin said subdi vision, and any purchaser or purchasers, <br />their heirs, administrators, executors and assigns, the <br />owners stipulate and agree that any and all lots in said <br />subdivision sold, transferred and conveyed, shall be and are <br />subject to the following protective covenants, restrictions <br />and conditions, all of which shall run with the land as <br />follows: <br /> <br />1. All dwelling units in the subdivision shall comply <br />with the City of Grand Island Building Code for R-3 <br />occupancy. No apartment house, nor shall any basement house <br />be built on any lot. No structure shall be erected, <br />altered, placed or per~itted to remain on any lot other than <br />dwelling and private garage for not iess than two cars, and <br />other secondary buildings incidental to the use of the plot. <br />No commercial or business enterprise shall be conducted or <br />operated in said addition. <br /> <br />2. .No building or dwelling house shall be moved into <br />said subdivision and placed upon a lot. No trailer, tent, <br />garage, shack or other .unsightly out-building, shall be used <br />in said subdivision as a dwelling at any time, nor shall any <br />structure of a temporary character be used as a residence. <br />No barns, chicken houses, house trailers, commercial work or <br /> <br />L <br /> <br />~ <br />
