<br />" <br /> <br />88- 102644 <br /> <br />PREFACE TO DEED OF TRUST <br />(Waiver) <br /> <br />The undersigned Trustors, being the same Trustors about to <br /> <br /> <br />execute the Deed of Trust, of which this Preface is a part in <br /> <br /> <br />respect to that real estate described as: <br /> <br />A tract of land comprising a part of the Northeast <br />Quarter (NEi) of Section Eight (8), Township Twelve <br />(l2) North, Ranae Nine (9) West of the 6th P.M., Hall <br />County, Nebraska, and more particularly described as <br />follows: <br /> <br />First, to ascertain the point of beginning, start at <br />the southeast corner of said Northeast Quarter (NEi); <br />thence northerly along and upon the east line of said <br />Northeast Quarter (NEi), a distance of Two Hundred <br />Sixty-One (261.0) feet: thence westerly, parallel with <br />the south line of said Northeast Quarter (NE1), a <br />distance of Thirty-Nine and Nineteen Hundreths (39.19) <br />feet to a point on the westerly right of way line of <br />U. S. Highway No. 281 and being the ACTUAL point of <br />beginning; thence continuing westerly along the last <br />described course a distance of Five Hundred Four and <br />Seventeen Hundredths (504.l7) feet: thence northerly, <br />parallel with the east line of said Northeast Quarter <br />(NE!), a distance of One Thousand Thirty and Four <br />Hundredths (1,030.04) feet: thence easterly, parallel <br />with the north line of said Northeast Quarter (NEi), a <br />distance of Five Hundred Three and Ninety-One Hundredths <br />(503.91) feet to a point on the westerly right-of-way <br />line of U. S. Highway No. 281: said point being Thirty- <br />Nine and Fifty-Five Hundredths (39.55) feet west of the <br />east line of said Northeast Quarter (NEU: thence <br />southerly along and upon said right of way line a <br />distance of One Thousand Twenty-Four and Eighty-One <br />Hundredths (1,024.81) feet to the ACTUAL point of <br />beginning and containing 11.887 acres, more or less, <br /> <br />hereby acknowledges: <br /> <br />TRUSTORS UNDERSTAND THAT SUCH TRUSTORS HAVE THE RIGHT <br />TO MAKE A DESIGNATION OF HOMESTEAD IN THE DEED OF TRUST <br />BUT HEREBY WAIVE THE SAME, UNDERSTANDING THAT THE <br />EXECUTION OF THIS WAIVER CONSTITUTES THE WAIVER OF <br />RIGHTS AVAILABLE FOR THE PURPOSE OF AFFORDING THE <br />TRUSTORS THE OPPORTUNITY TO RETAIN HIS OR HER HOMESTEAD <br />IN THE EVENT OF A DEFAULT UPON SUCH DEED OF TRHST. <br />.;tT <br />Acknowledged this ~I day of May, 1988. <br /> <br /> <br /><;(~rJ6Qdf 9~~~ <br /> <br />Ronald L.
