<br />-5- <br /> <br />88- 102198 <br /> <br />The parties stipulated that the settlement stipulation <br />of October 21, 1986, should be amended as foliows:' <br />The Claimants, Robert Mettenbrink and May Mettenbrim; <br />'. <br /> <br />agree to convey to the Personal Representative their right, <br />title, and interest in and to all of the real estate involved <br />in this Estate, including the one percent interest of Robert <br />Mettenbrink in Case No. 88-122. In return, the Personal Repre- <br />sentative agrees to convey to Robert Mettenbrink and May Metten- <br />brink a tract of land comprisinq the Claimants' personal resi- <br />dence and improvements which are situated on a tract of land <br /> <br />in the East Half of the SQuthwest Quarter (E~SW.) of Section <br />16-12-9, Hall County, Nebraska. The exact legal description <br />of the tract shall be determined from a survey which shall be <br />procured and paid by the Personal Representative as a ,cost of <br />administration. If it is determined that',platting is required <br />or Board of Adjustment approval is necessary, the Claimants <br /> <br />agree to pay such costs. <br />The Personal Representative shall then proceed to sell <br />all of the real estate at public auction on January 15, 1987, <br />or as soon thereafter as is reasonably possible. After pay- <br />ment of expenses of sale, liens, and costs of administration, <br /> <br />. <br />the balance remaining on hand shall be distributed to Wilma <br />Belanqie, Mary Thompson, Robert Mettenbrink, Kelly Ann Emery <br />and Joseph C. Emery, pursuant to the laws of the State of <br /> <br />Nebraska for descent and distribution in an intestate estate. <br />
